Auction starts at 12 Noon By using a bid number, the bidder acknowledges he has received, read and understands and agrees to be bound by the terms and conditions of the auction either posted at the specific auction site or online. When you sign up for a bidder number either at the auction site or by clicking the accept button online, you enter in to a binding legal agreement with Auction Sales Co. Auction Sales Co. is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Auction Sales Co. or anyone else if the Internet service fails to work correctly before or during the live auction. Auction Sales Co. will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Auction Sales Co. reserves the right to withdraw or re-catalog items in this auction. PREVIEW & INSPECTION: Items located at 1400 US Hwy 197 The Dalles OR, except for 3 tanker trailers located at Hood River County Shop Yard in Hood River, OR. All Items are available for inspection as soon as the arrive at sale site. All items have to be on site by May 23rd. It is important that the buyer avail themselves of the inspection periods. All items sold “AS IS” meaning the bidder is responsible for due diligence in inspecting all items. Auction Sales Co. will pass on any information, good or bad, that the seller gives to us in describing the items. However, it is up to buyer to determine the condition of the item they are bidding on. All descriptions are believed to be correct. Auction Sales Co. makes no warranties or guarantees, assumed, neither expressed or implied in the accuracy of the descriptions, nor will be held responsible for any advertising errors, discrepancies or inaccuracies. When a bidder is awarded the bid on an item, that bidder instantly becomes the new owner of that item and is completely responsible for that item as soon as the Auctioneer says sold and the hammer drops for that item & your bid number is announced as the buyer. Payment in full must be made sale day, unless you have previously made special arrangements with auction management. No bid will be invalidated due to the bidder’s inability to remove or provide their own shipping arrangements. PAYMENT: Auction Sales Co. accepts cash, credit cards and checks if we have done business with you in the past. If you are a first time customer, a letter of guarantee from your bank is required with a check. Wire transfers accepted with sale day deposit of 25%, if arrangement has been made before sale day. Purchases cannot be removed from the auction site or collected until paid for in full. If paid for with non-certified funds, items will not be released until funds clear our bank. BUYER'S PREMIUM: Premium will be added to each item purchased at the following rate: Items selling up to $5000.00 – 10% Items selling from $5001.00 to $10,000.00 – 5% Items selling above $10,001.00 – 2.5% INTERNET BIDDERS: SUCCESSFUL INTERNET PURCHASES WILL BE CHARGED AN ADDITIONAL 2.5% FEE CAPPED AT $750.00 per item. CREDIT CARD PURCHASES: An additional 3% processing fee will be charged. We accept: Visa, Master Card, and Discover. INTERNET PARTICIPATION REQUIREMENTS: Proof of Valid Credit Card ITEM PICKUP: The Buyer is solely responsible for picking up his/her own purchases. Items may be picked up on Sale Day until 6 pm, and the week following the auction. All items need to be picked up by Friday June 6th. GENERAL TERMS: All articles of merchandise are offered "As Is, Where Is" by lot, individually or in groups as announced by the auctioneer at time of sale. No claim will be considered for allowance adjustment or rescission of any sale based upon the failure of the property to correspond to any particular standards or expectations of the buyer. The auctioneer reserves the right to group, modify, increase, diminish or delete lots at his sole and absolute discretion. All sales are final, when awarded to the successful bidder. Buyer accepts full responsibility for all purchases made and holds Auction Sales Co. and the Owners free of any liability in the event of theft or disappearance of any items purchased. Items purchased are the sole responsibility of bidder once their buyer number is announced. All purchases must be checked out by an authorized Auction Company representative before leaving the premises. PURCHASER SHALL MAKE HIS OWN ARRANGEMENTS FOR INSURANCE COVERAGE FOR ALL ITEMS PURCHASED. The purchaser hereby agrees to indemnify and hold harmless Auction Sales Co and the seller, against any and all liability, loss, costs, damages and other expenses arising from attending the auction or the loading out of equipment by Auction Sales Co. on the purchaser's behalf. All lots must be removed within the time announced or posted at the sale, at purchaser's sole cost and risk, and only in a manner approved by auctioneer. If for any reason the purchaser fails to remove any lot within the time specified, the lot shall be deemed abandoned, and the auctioneer may resell or remove from the auction site, and/or store the said lots at purchaser's sole risk and expense. In addition, purchaser shall be liable for any rent incurred or damages suffered by auctioneer because of the purchaser's failure to timely remove any lot. Prior to the commencement of loading, dismantling, rigging or cutting or any operation affecting buildings or land, purchaser shall furnish certificates, satisfactory to auctioneer, holding auctioneer harmless for any claims concerning damage or injury to persons or property arising out of any such acts. All equipment used in connection with removal, shall itself be removed with the purchased lots. All rights, privileges and powers reserved or granted to auctioneer in these Terms of Sale shall be deemed reserved and granted to auctioneer's employees, advertising representatives, and all owners for whom the lots are being sold. Auctioneer does not accept responsibility for the failure of any equipment sold to meet the safety standards on classifications of equipment by the Department of Labor Safety and Health Regulation, Federal OSHA or the Environmental Protection Agencies. It is the express responsibility of the buyer to determine what safety equipment must be in service on any machinery purchased and to comply with these regulatory requirements prior to using any equipment, machinery or vehicles purchased from Auction. In the event Auction Sales Co. is required to employ an attorney to enforce any term of the agreement, purchaser agrees to pay reasonable attorney's fees, in addition to all court costs.
