Any dispute arising out of the Auction, the purchase of any Merchandise, the removal of any Merchandise, or anything in any way connected to this agreement, shall be governed by the laws of the State of Minnesota. The Bidder/Buyer expressly agrees that any legal action shall be brought in the state court located in St. Cloud, Minnesota and the Bidder/Buyer waives any right to assert the doctrine of forum non-conveniens or to object to venue under any other applicable statute, rule, or right. Notwithstanding anything to the contrary contained herein If you are sending a shipper or freight truck to pick up your purchases, the shipper/freighter is also responsible for packing your purchases Buyer's of major machines will have two (2) weeks to remove these. An appointment will need to made with our Office least 24 hours prior to removal . ***** IMPORTANT PLEASE READ ************************************* If sending a Freight Company or third party to pick up your purchases, a bill of lading MUST be emailed to auction@schultzauctioneers.com or MUST accompany the driver at the time of pick up. Schultz Auctioneers MUST NOT be listed as the shipper. The BOL must also mention the purchaser as well as the items they are authorized to pick up. Items will not be loaded and BOL will not be signed if our. company is listed as the shipper. NO EXCEPTIONS. Any item not picked up may be considered abandoned and no refund will be issued. Visa/MasterCard. No property removed until fully settled for. After the Auction Co. has sold a piece of equipment, it becomes the sole responsibility of the purchaser. All equipment is sold as is and where is. The information contained in this listing is subject to inspection and verification by all parties relying on it.
