AUCTION COMPANY DOES NOT PROVIDE SHIPPING -- Shipping/Trucking is NOT available.
If you would like items shipped and/or prepared for trucking you must make your own arrangements.
Removal shall be at the expense, liability and risk of Purchaser within the time period announced by Auctioneer, who shall not be responsible for goods not removed within time specified. Failure to remove any item within allotted time will result in nullification of purchase and ownership will revert to Seller with no refunds extended
Buyer shall be responsible for any and all actual, consequential, and incidental damages to the Real Estate or other property located on the Real Estate caused directly or indirectly by the Buyer, his agent, employees, or independent contractors during rigging or removal. The Buyer shall also be responsible for the reasonable attorneys fees of any party that is forced to bring suit against the Buyer to enforce this paragraph or the terms and conditions of this Agreement. Any dispute arising out of the Auction, the purchase of any Merchandise, the removal of any Merchandise, or anything in any way connected to this agreement, shall be governed by the laws of the State of Minnesota. The Bidder/Buyer expressly agrees that any legal action shall be brought in the state court located in St. Cloud, Minnesota and the Bidder/Buyer waives any right to assert the doctrine of forum non-conveniens or to object to venue under any other applicable statute, rule, or right. If you are sending a shipper or freight truck to pick up your purchases, the shipper/freighter is also responsible for packing your purchases
Buyer's of major machines will have two (2) weeks to remove these. An appointment will need to made with our Office least 24 hours prior to removal
. ***** IMPORTANT PLEASE READ ************************************* If sending a Freight Company or third party to pick up your purchases, a bill of lading MUST be emailed to auction@schultzauctioneers.com or MUST accompany the driver at the time of pick up. Schultz Auctioneers MUST NOT be listed as the shipper. The BOL must also mention the purchaser as well as the items they are authorized to pick up. Items will not be loaded and BOL will not be signed if our. company is listed as the shipper. NO EXCEPTIONS.
Any item not picked up may be considered abandoned and no refund will be issued.
