FIREARMS: If you pick your firearm(s) up in person, you may pay by cash or good check. The person taking possession of the firearm(s) must be the actual purchaser/owner.
If you will be taking possession of your firearm(s) through another FFL holder, your licensee may submit a copy of their license to us by email at: adam@bennettauctionservice.com. See Special Terms of Sale for information on firearms transfers. We accept Mastercard and Visa.
OTHER ITEMS: If you pick your items up on the day specified below in the CHECKOUT DATES AND TIMES section, you may pay by cash or good check.
A Cashier's check is required for payment over $2,500.00. If you do not pick your items up or make other arrangements with us in advance, we will charge your credit card for the total due (purchase price, buyers premium, and tax or fees if applicable). We will then pack and ship your items, and a second charge will be made to your credit card for these costs (see Shipping Instructions for details). Please be advised that the cost of packing and shipping is an additional cost, and will not be specified or included on your initial invoice. We accept Mastercard and Visa. Most of our sales are tax exempt. Exceptions are business inventory, vehicles, trailers, boats, and other stuff that's licensed or registered. Even then, out of state buyers may be exempt.

Terms Of Sale
1) All items offered for sale are open to thorough public inspection. Bidders who choose not to attend the Preview understand and acknowledge that they may not be able to inspect an item as well as if they had examined it in person. It is the Bidder's responsibility to assess condition, age, authenticity, value and other determinative factors. Bennett Auction Service shall endeavor to describe in detail each item or lot and any pertinent information about it, but shall not be held responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item or lot itself.
2) We primarily do estate work and also sell on consignment. Since we don't own the merchandise we sell, we cannot take returns. All property is sold as is, and all sales are final. Nonetheless, if you feel an item was misrepresented, please contact Adam directly at 715-657-0078 so that we might try to resolve your dissatisfaction.
3) If your credit card on file won't process, or if you've registered with a debit card which doesn't have enough on it to cover your purchases and shipping, we reserve the right to charge a 'chase fee' to cover administrative costs incurred in settling things, not to exceed $25. Bidders who choose not to cooperate in resolving nonpayment will be turned over to Proxibid and may ultimately be banned from the entire Proxibid system. Bidder forfeits the right to instigate credit card charge backs and shall contact Bennett Auction Service directly with disputes and/or claims. Bennett Auction Service shall refund Bidder's credit card for any claim that Bennett Auction Service deems legitimate. We value our buyers and treat them fairly.
4) Please understand that we need your purchases removed from the premises as soon as possible so that we have room to work on future sales. If you don't pick up during the time specified below in the Checkout Dates and Times section or contact us prior to the specified pickup time to make other arrangements, we will ship your items, if shippable. If we need to move your purchases off site to either ship them or hold them for a later pick up, we may charge a reasonable fee for those services.
5) Any mediation, arbitration, or litigation shall take place exclusively in Price County, Wisconsin, U.S.A.

**TERMS SPECIFIC TO FIREARMS AND OTHER REGULATED ITEMS**
FFL's may be mailed to Bennett Auction Service, 1647 Town Street, Prentice, WI 54556
or emailed to adam@bennettauctionservice.com
TRANSFER OF FIREARMS: All Wisconsin residents that purchase non-antique firearms (as defined by the BATFE) and all nonresidents that purchase non-antique long guns and intend to take possession of their firearms purchases at Bennett Auction Service, 700 Main Street, Prentice, Wisconsin must first successfully complete an ATF Form 4473 and must not be denied by either a NICS background check or WI Handgun Hotline background check, as applicable. Face-to-face transfers of non-antique handguns to WI residents also require a two day waiting period before transfer. Alternately, non-antique firearms may be shipped to a Federal Firearms License (FFL) holder for legal transfer to the purchaser. Please provide us with a signed copy of the FFL holder's license (by postal mail or email) that will be handling the transfer, and we will ship the firearm(s) to the licensee. We cannot ship non-antique handguns or long guns directly to purchasers, nor will we ship firearms out of the United States. All firearms that enter or exit our facility must be unloaded and in a locked case, as we are within 1,000 feet of a School Zone.
COSTS OF TRANSFER: We charge a $10 fee for calling in to NICS or the WI Handgun Hotline and the accompanying paperwork. The $13 Handgun Hotline charge is also passed along to the buyer.
BUYERS WHO DO NOT OR CANNOT TAKE POSSESSION OF A PURCHASED FIREARM: If a buyer is determined legally ineligible to take possession of a firearm, or if the buyer chooses not to take possession of the firearm, the buyer is still responsible for payment in full of the gavel price plus all applicable buyer's premiums, taxes, and/or additional expenses. The buyer may then either request shipment (at the buyer's expense) to an FFL holder who will resell the firearm on the buyer's behalf, or request that Bennett Auction Service resell the firearm on the buyer's behalf at the current and reasonable rate of commission.
FIREARMS AND OTHER RESTRICTED/REGULATED ITEMS: The buyer is solely responsible for knowing and complying with all federal, state, and local laws that apply to their ownership and/or possession of firearms or other restricted/regulated items. This is not our responsibility. If you cannot legally own something we are selling, do not bid on it. If you are unsure if you can legally own something we are selling, find out before bidding.
