TERMS & CONDITIONS of ANNUAL SPRING CONSIGNMENT AUCTION 1400 US HWY 197 THE DALLES OR 97058 By using a bid number, the bidder acknowledges he has received, read and understands and agrees to be bound by the terms and conditions of the auction either posted at the specific auction site or online. When you sign up for a bidder number either at the auction site or by clicking the accept button online, you enter in to a binding legal agreement with Auction Sales Co. Auction Sales Co. is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Auction Sales Co. or anyone else if the Internet service fails to work correctly before or during the live auction. Auction Sales Co. will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Auction Sales Co. reserves the right to withdraw or re-catalog items in this auction. PREVIEW & INSPECTION: Items located at 1400 US Hwy 197 The Dalles OR 97058 All Items will be available for inspection from the time they arrive at the Auction Yard until Auction Time during regular business hours. It is important that the buyer avail themselves of the inspection periods. All items sold “AS IS” meaning the bidder is responsible for due diligence in inspecting all items. Auction Sales Co. will pass on any information, good or bad, that the seller gives to us in describing the items. However, it is up to buyer to determine the condition of the item they are bidding on. All descriptions are believed to be correct. Auction Sales Co. makes no warranties or guarantees, assumed, neither expressed or implied in the accuracy of the descriptions, nor will be held responsible for any advertising errors, discrepancies or inaccuracies. When a bidder is awarded the bid on an item, that bidder instantly becomes the new owner of that item and is completely responsible for that item as soon as the Auctioneer says sold and the hammer drops for that item & your bid number is announced as the buyer. Payment in full must be made sale day, unless you have previously made special arrangements with auction management. No bid will be invalidated due to the bidder’s inability to remove or provide their own shipping arrangements. PAYMENT: Auction Sales Co. accepts cash, credit cards and checks if we have done business with you in the past. If you are a first time customer, a letter of guarantee from your bank is required with a check. Wire transfers accepted with sale day deposit of 25%, if arrangement has been made before sale day. Purchases cannot be removed from the auction site or collected until paid for in full. If paid for with non-certified funds, items will not be released until funds clear our bank. BUYER'S PREMIUM: Premium will be added to each item purchased at the following rate: Items selling up to $5000.00 – 10% Items selling from $5001.00 to $10,000.00 – 5% Items selling above $10,001.00 – 2.5% INTERNET BIDDERS: SUCCESSFUL INTERNET PURCHASES WILL BE CHARGED AN ADDITIONAL 2.5% FEE CAPPED AT $750.00 per item. CREDIT CARD PURCHASES: An additional 3% processing fee will be charged. We accept: Visa, Master Card, and Discover. INTERNET PARTICIPATION REQUIREMENTS: Proof of Valid Credit Card ITEM PICKUP: The Buyer is solely responsible for picking up his/her own purchases. Items may be picked up on Sale Day until 6 pm, and the day following the auction. All items need to be picked up by Saturday April 25th 2015 GENERAL TERMS: All articles of merchandise are offered "As Is, Where Is" by lot, individually or in groups as announced by the auctioneer at time of sale. No claim will be considered for allowance adjustment or rescission of any sale based upon the failure of the property to correspond to any particular standards or expectations of the buyer. The auctioneer reserves the right to group, modify, increase, diminish or delete lots at his sole and absolute discretion. All sales are final, when awarded to the successful bidder. Buyer accepts full responsibility for all purchases made and holds Auction Sales Co. and the Owners free of any liability in the event of theft or disappearance of any items purchased. Items purchased are the sole responsibility of bidder once their buyer number is announced. All purchases must be checked out by an authorized Auction Sales Co. representative before leaving the premises.
