Payment
There will be a 10% Internet Premium on all items.
All vehicles, trailers, RV's, or motorcycles shall be paid for by Cash, Wire Transfer, Cashier's Check or a Check accompanied by a Bank Letter of credit. Possession of the vehicles, trailers, RV's, or motorcycles shall be given once the payment has been made. Titles and/or Bill of Sales to items shall be available approximately 10 business days after the auction, or after the funds have cleared. All vehicles, trailers, RV's and motorcycles must be picked up from the auction facility located at 3200 W. Modelle in Clinton, OK no later than June 16th. Purchaser shall be responsible for making and paying for any shipping arrangements.
Payment is due upon conclusion of the auction, unless you purchase a vehicle, trailer, RV, etc., then payment in FULL must be made by the end of the first business day, Monday, June 8, 2015, following the Auction. If you are a winning bidder and have not heard from us within 24 hours of the auction, please contact us at info@heardauction.com for payment instructions.
Sales tax of 9.5% will be charged on all items shipped within the state of Oklahoma. NO SALES TAX will be charged on any vehicles or items shipped out of the state of Oklahoma.

It is the bidder's responsibility to determine overall condition before bidding on an item.
All property is sold AS-IS, and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Bidder shall be the sole judge of value. Bidders who bid from off site and are not present at the live auction acknowledge that they may not be able to inspect an item as well as if they examined it in person. HEARD AUCTION & REAL ESTATE, LLC shall endeavor to describe in detail each item and any pertinent information about it via telephone prior to auction. If you have questions about the merchandise, the time to ask questions is well in advance of the live auction. We want you to be happy with your purchases. Thank you for your patronage.
The auctioneer shall advance the bidding at his own discretion. HEARD AUCTION & REAL ESTATE, LLC may withdraw any item before or during the auction. Should a tie or a dispute arise between two bidders, the auctioneer may, at his discretion, reopen the bidding until the property is sold. The record of the auction made by HEARD AUCTION & REAL ESTATE, LLC shall be conclusive.
Should a dispute arise between HEARD AUCTION & REAL ESTATE, LLC and Bidder, Bidder waives any right to a trial or hearing in a court of law and agrees to settle the dispute through binding arbitration in Oklahoma
