Item Details
- No items will be shipped by the auction company. It is the buyers responsibility to arrange any type of shipping or pick up of purchases.
- A deposit of at least 25% of invoice total must be received by 4:00 pm on Monday 6/1/15. Deposits will be accepted in the form of cash, credit card or wire transfer.
- All invoices for purchases must be paid for in full and all items removed by 4:00 pm on Tuesday 6/2/15
- If high bidder should fail to post the required deposit within the time posted, the deposit will be charged to the credit card on file for the bidder. In the event that a deposit can not be collected, the sale will be considered immediately null and negated, the item will be offered for sale again as soon as possible. Failure to complete the transaction as described will cancel the sale, and any monies collected as a deposit will be considered forfeited and the items will be offered for sale again as soon as possible. In the event an item must be offered in a secondary sale, any deficiency between the original selling price and the subsequent sale price will result in collection efforts to be pursued against the original bidder.Invoices that have not been paid for or arrangements made for payment by end of day 6/2/15 will have purchases charged using credit card on file.
- All items offered are subject to redemption prior to the end of sale. If items are removed or redeemed prior to the conclusion of the sale, all participating bidders up to that point will be notified by email.
Payment
To obtain the 3% cash discount, buyers must contact the auction house by the close of business the day following the auction to inform that a payment will be made with cash or certified funds.
All buyers will be contacted to confirm charges to credit cards.
Acceptable payments that are eleigible for the cash discount are Certifed Checks, Money orders, wire transfers, and of course cash. Company checks will be accepted at the auction house discrection.

Terms Of Sale
Because this is a Court Ordered Sale, all items are subject to redemption prior to the conclusion of the sale. Redemption will not be allowed following the conclusion of bidding. If a redemption is ordered, the sale will be cancelled and all bidders will be notified.
Prospective buyers are advised that each and every item or lot will be sold to the highest bidder for cash or it’s equivalent.
The balance of purchases and fees will be due prior to pick up or release of the items or lots. If no purchases are recorded, or if high bids are rejected by selling agency, any money placed as a deposit will be refunded to buyer.
C. B. Kaye & Associates expressly reserves the right to determine the manner of conducting the auction and the right to sell items or lots by individual or group lots as it deems appropriate.
C. B. Kaye & Associates assumes no liability for errors or omissions in this or any other listing.
The buyer acknowledges that they or their agent has inspected all items which they will be bidding on or eventually purchasing.
Buyer agrees to accept items purchased “AS IS, WHERE IS, WITH ANY AND ALL FAULTS” and “WITH NO WARRANTIES OF ANY KIND”. The auctioneer expressly disclaims for itself and as agent of any seller any warranty as to fitness for particular use or merchantability of all items offered.
The buyer expressly waives any claim in respect to any possible future use of any item purchased for any purpose whatsoever. The buyer does hereby assume and does agree to indemnify and hold the auctioneer, his agents and any sellers harmless from any and all future claims or liability.
Items may be offered for sale with Reserve or Minimum Bid Requirements.
Bidders are advised that failure to pay for purchases in full within the posted payment requirements may result in a cancellation of the sale. A cancellation may result in the item being offered for sale in a subsequent sale, either through public auction or private negotiated sale. Non paying bidders agree that they may be financially liable for any differance in lost sale values and buyers fees. Non paying bidders may be charged all expenses related to the collection of lost fees and charges.
NOTHING MAY BE REMOVED UNTIL THE BUYER HAS PAID IN FULL.
ALL GOODS TO BE REMOVED AT THE RISK AND EXPENSE OF THE BUYER, PLEASE BRING YOUR OWN EQUIPMENT AND ASSISTANCE FOR REMOVAL OF ITEMS. ITEMS MAY BE LOADED BY THE SELLER AT THEIR DISCRETION. ALL BUYERS AND CONTRACTORS USING EQUIPMENT TO REMOVE ITEMS MUST SHOW PROOF OF LIABILITY INSURANCE.
Failure to remove items within the listed times, whether paid or not, shall make any deposits subject to forfeit.
