In no event shall Bill Perkins Auction & Realty LLC be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of genuineness, value and condition of any item purchased. All coins, currency, fine art, automobiles or any other purchases that may have condition grading scales are being purchased at the sole responsibility of the buyer. Grading scales vary and one expert may grade an item totally different than another. If any grading past or present is included in the description or representation of any lot/item being sold, it is only the opinion of a 3rd party. Additional pictures will be made available if requested. In case of coins only U.S. coins have been checked for their gold and silver content. COINS AND CURRENCY ARE NEVER KEPT ON-SITE! If a physical inspection of coins or currency is requested it is at the sole discretion of the auctioneer. Any items not paid for at the auctions end will be in default. Auctioneer will attempt to collect for a period of 5 business days from day of auction. After 5 business days have passed and full payment has not been made, buyer forfeits any rights to the purchase and forfeits any partial payments that may have been made. The seller of the items regains ownership at said time. Bidder agrees that this agreement shall be governed by the laws of the state of Wisconsin and hereby grants sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in Rock County, Wisconsin. Bidder agrees and grants that service of process on them may be obtained by mailing a certified letter, containing a summons, postage prepaid, to them at the address they provided to register. Should a dispute arise between Bill Perkins Auction & Realty LLC and Bidder, Bidder waives any right to a trial or hearing in a court of law and agrees to settle the dispute through binding arbitration in Rock County, Wisconsin. Bidder further agrees that under no circumstances will he/she initiate a charge back on his/her credit card per these terms and condition that all sales are final with no refunds or returns. Bidders who bid from off site and are not present at the live auction or preview if available understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Bill Perkins Auction & Realty LLC shall endeavor to describe in detail each item and any pertinent information about it. Bill Perkins Auction & Realty LLC will not be responsible for any errors or omissions in the description of the merchandise unless proven to be an intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase. Bill Perkins Auction & Realty LLC is providing Internet pre-auction, live bidding, and sometimes an on-line only auction as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Bill Perkins Auction & Realty LLC or anyone else if the Internet service fails to work correctly before or during the live auction. Bill Perkins Auction & Realty LLC will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins.
