Payment
Everything must be paid in full within 24 hours of the conclusion of the auction. Payment shall be made by money order, certified check, valid personal or business check, or bank wire. Call for wiring instructions prior to the auction. Personal Checks must be pre-approved by the Auction Co, (call for details). All items purchased with personal checks will be held until said check clears. Any shipping and trucking costs will be paid for by the buyer.
No sales tax is charged at this auction. Unless exempted by law, the purchaser shall pay any and all applicable taxes. Bidder agrees to indemnify Donnelly Auctioneer and Appraisal Service against any claim if sales tax is not collected on bidder's purchases.

All persons attending the auction sale or removal of merchandise assume all risks of damage to person or property and specifically release and indemnify Donnelly Auction and Appraisal Service from any liability. All property is sold 'AS IS', with no guarantees or warranties and ALL SALES ARE FINAL. Announcements day of sale take precedence over printed material. Property is open to thorough public inspection. It is the bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Donnelly Auctioneering and Appraisal Service may attempt to describe the merchandise in advertising, on the internet, and at the auction, but make no representations. In no event, shall Donnelly Auctioneering and Appraisal Service be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidders shall be the sole judge of value.
All internet bidders agree to pay an internet fee equal to 18% of the hammer price of each item they purchase. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examine it in person. It is the bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Donnelly Auctioneering and Appraisal Service shall endeavor to describe in detail each item and any pertinent information about it. Donnelly Auctioneering and Appraisal Service will not be responsible for any errors or omissions in the description of the merchandise unless it is a material or intentional misrepresentation of the item itself. Bidder agrees that everything is sold 'AS IS' 'WHERE IS' and they may not return any item they purchase for any reason.
Donnelly Auctioneering and Appraisal Service is providing internet pre-auction and live bidding as a service to the bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall bidder have any kind of claim against Donnelly Auctioneering and Appraisal Service, any of its employees, or anyone else if the internet service fails to work correctly before or during the live auction. Donnelly Auctioneering and Appraisal Service will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the Proxy bidding feature and leave their maximum bid 24 hours before the auction begins. Donnelly Auctioneering and Appraisal Service reserves the right to withdraw or re-catalog items in this auction.
The auctioneer shall advance the bidding at his own discretion. Should a tie or a dispute arise between two bidders, the auctioneer may, at his discretion, reopen the bidding until the property is sold. The record of the auction made by Donnelly Auctioneering and Appraisal Service shall be conclusive and final. When the auctioneer says 'SOLD' bidder assumes full responsibility for the merchandise.

Any merchandise not removed by bidder will be resold or disposed of in any other way Donnelly Auctioneering and Appraisal Service deems to be suitable in a timely manner and the proceeds from the sale will be kept by Donnelly Auctioneering and Appraisal Service. Donnelly Auctioneering and Appraisal Service may refuse a buyer's number to anyone for any reason. Bidder agrees to provide any identification Donnelly Auctioneering and Appraisal Service may request including but not limited to driver's license, photo copy of credit card, social security card, passport. Bidder agrees to comply to any stated additional terms or conditions associated with particular items. Our goal is for you to be satisfied with your purchase. If you have any questions about the merchandise or terms of the sale call within 48 hours of the live auction. No returns are allowed. Donnelly Auctioneering and Appraisal Service may not know all the individual local, city, and state restrictions for the products we sell. Therefore, we do not warranty that you may legally purchase, resell, own, or use specific products offered by our company. Many cities and states prohibit certain products and you must be in compliance with local laws regarding these products.
Due to the complexity of modern electronics and digital photography, it is often impossible to get an exact and consistent reproduction of color. Therefore, the only flawless manner to assess the color saturation and detail of any graphic is by personally inspecting the items up for auction. Donnelly Auctioneering and Appraisal Service will not be responsible for any variation between the catalog/internet image and the actual piece. CONDITION OF ITEMS
Donnelly Auctioneering and Appraisal Service makes every effort to accurately describe all items offered in its sales including authenticity, however all items for sale are "as is," and it is the bidder's responsibility (present or absentee bidders) to determine the exact condition of each item. With respect to any returns, it is the buyer's responsibility to cover the cost of shipping and insurance, regardless of the reason for the return.
