Terms Of Sale
TERMS OF SALE:
1 This private Timed Sale is conducted by Godfrey & Kahn, S.C. (hereinafter GK) for its shareholders, members and employees as GK shall determine and authorize. It is a Timed Sale and not a live auction. Pursuant to Wis. Stat. §480.02(2)(d) this sale is exempt from Wisconsin auction statutes and terms. Please direct any questions about the status of this sale to the attention of Robert Mueller.
2 This is a Timed Sale commencing at 12:00 P.M. CST on Wednesday, February 10, 2016 and ending at 12:00 P.M. CST on Wednesday, February 24, 2016.
3 This Timed Sale will be conducted on the Internet and hosted by ProxiBid. You must register and be approved in order to bid. Bidding will be limited to parties approved by GK.
4 A few items are offered with Reserve prices. For these items, bidding begins at an amount that is lower than the Reserve price. If the Reserve price – which is confidential – is met, then the item must be sold to the high bidder. If the Reserve price is not met, the item is regarded as unsold and it is up to the seller decide whether to sell the item and upon what terms.
5 There will be no formal sale preview but property can be examined at any time during regular business hours at the GK premises or, for property located at the GK warehouse, by arrangement. Whenever possible, we have included an approximate location for each item within the description of that item. GK requested that items not be conspicuously marked for this sale. When possible, we placed a round, yellow BDA sticker upon an item with its GK inventory number. Please note that the GK Inventory Number is not the same as the auction catalog number because the auction catalog was assembled long after the GK inventory. The auction catalog incorporated the GK numbers, but you will have to cross-reference any round BDA tag number with the GK number as noted in any auction lot. Some items have been moved since the auction catalog inspection (and are therefore not in their noted locations) and some items were never labeled (particularly items that could not be labeled inconspicuously). If you need assistance locating an item, please contact Hope at HSeegert@gklaw.com
6 Items that include the term “Appraised Replacement Value: …” in the description were appraised by Gary Piattoni, Inc. in 2008 for the purpose of insurance. These valuations are included as a reference for what the replacement value – in the opinion of Gary Piattoni – of the item was in mid-2008. The opening bid price is less than this (often substantially so) because it is based upon the marketable cash value of the item. Please contact Steve Brondino at steve@brondino-davidson.com if you require further clarification of the distinction between replacement and marketable cash values.
7 Buyers will be charged a 5.6% sales tax upon all purchases. There are no other charges or additional costs to the buyers.
8 After the sale closes, buyers will be invoiced. Payment may be made by check to Vickie at GK or by PayPal to steve@brondino-davidson.com Payments made through PayPal can, in turn, be charged to your Visa or MasterCard account. All invoices must be paid promptly upon receipt.
9 After Payment has been made, buyers will be contacted by GK to make arrangements for the pick-up and delivery of purchases. GK will arrange, upon request, delivery by a professional mover and the cost of any mover will be a separate charge to a buyer. Purchases may be picked up / removed immediately after the auction with the following exception: items located in the public areas on the 17th floor may not be removed until March 3, 2016. For more information about moving items, contact Vickie at VBence@gklaw.com
10 GK makes no representations or warranties with respect to the authenticity or condition of any property. Buyers bid at their own risk and purchase all property "as is." Bidders should inspect all property in person prior to bidding and make their own determinations of condition, authenticity and any other aspects of the property that are of concern and importance.
11 Bid Increments. Bidding advances at the following increments (based upon the opening bid price):
$25-99.99: $5; $100-249.99: $10; $250-499.99: $25; $500-999.99: $50; $1,000-4,999.99: $100; $5,000-24,999.99: $250
