***BUYER'S PREMIUM AND TAX: An 18% buyer's premium will be applied to all winning bids. No sales tax will be charged.
***PAYMENT: All purchases must be paid for before merchandise is removed from auction premises. ***FIREARMS REMOVAL: Any legal Indiana buyers (age 21 for handgun, age 18 for long gun) with a valid photo ID may pick up firearms at the sale location until 3:00 p.m. day of sale. After that time, any uncollected firearms will be taken into auctioneer's possession as FFL #4-35-05782, and the buyer must complete a legal FFL transfer and pass a NICS background check at our office in New Haven, IN. There is no transfer fee. The registered Proxibid bidder must pay for and collect the firearm, in that order. THERE WILL BE NO EXCEPTIONS TO THESE TERMS.
No guns will be sold to bidders with California residence, period.
Any buyers from any state other than Indiana may collect long guns from the sale location day of sale until 3:00 p.m. After that time, any uncollected firearms will be taken into auctioneer's possession as FFL #4-35-05782, and the buyer must complete a legal FFL transfer and pass a NICS background check at our office in New Haven, IN. Any buyers from any state other than Indiana MUST have hand guns shipped to an FFL licensee in their state of residence. There is no transfer fee. Any firearms that need to be shipped must be paid for in full (including package/postage fees), and will be shipped to an FFL licensee in the buyer's state of residence. THERE WILL BE NO EXCEPTIONS TO THESE TERMS.
***REMOVAL: Items may be collected from the sale location until 3:00 p.m. day of sale. Otherwise, items may be collected from our office in New Haven during regular business hours Monday, Tuesday, Thursday, Friday. All items must be paid for in full before they may be removed from removal location. All items MUST be removed during announced removal period. Items paid for and not removed after 30 days from the last announced removal date will be stored by auctioneer at a rate of $100 per month per invoice, which must be paid before items will be released by auctioneer. All loading, removal, shipping, and associated expense, risk and liability are the responsibility of the buyer.
***SHIPPING: Buyer will pay for postage and an appropriate handling fee to cover our cost of time and materials. No sale will be voided or adjusted to account for unforeseen shipping/freight costs or complications. Please satisfy all inquiries before you buy!
***CONDITION OF ITEMS: Neither the auctioneer nor the seller shall be responsible for the correct description, genuineness, authenticity of, or defect in any article. The auctioneer will make a good-faith effort to correctly describe all articles and their condition; however, neither the auctioneer nor the seller will make any guarantee or warranty regarding the accuracy of article descriptions. NO SALE WILL BE VOIDED OR ADJUSTED TO ACCOUNT FOR INCORRECT DESCRIPTION, CATALOG ERROR, OR IMPERFECTION NOT NOTED. ALL ITEMS ARE SOLD AS-IS, WHERE-IS, WITH NO WARRANTIES EXPRESSED OR IMPLIED. IT IS THE RESPONSIBILITY OF THE BIDDER TO INSPECT ALL ARTICLES AND SATISFY ALL INQUIRIES BEFORE BIDDING!
***INSPECTION: All articles will be made available for public inspection Friday, June 3, 12:00-5:00. Bidders may also contact the auctioneer at any time prior to the auction to discuss articles being sold. It is the responsibility of the buyer to satisfy all inquiries regarding article description and condition prior to bidding. All items are considered to be in good used condition, and the auctioneer will not point out every flaw resulting from normal use. Auctioneer will make a good-faith effort to make evident, either by picture or text, any significant flaw or damage.
***INDEMNIFICATION: Purchaser shall defend and indemnify and hold auctioneer and seller harmless from and against all claims and liabilities relating to the condition of, removal of, or use of the articles purchased or failure of user to follow instructions, warnings or recommendations of the manufacturer, or to comply with federal, state, and local laws applicable to such articles, including OSHA requirements, and Environmental Protection Agency requirements, or for proximate or consequential damages, costs or legal expenses arising there from.
***RESPONSIBILITY FOR ARTICLES: At the time each article is sold, ownership of and responsibility for that article is transferred immediately to winning bidder. After articles are removed from auction location or the announced removal period has ended, the auctioneer and the seller will have no obligation to the winning bidder and no responsibility for articles sold.
***ACCEPTANCE OF TERMS AND CONDITIONS: Any and all bids made by any and all bidders are legally binding contracts to purchase articles for the price offered according to the terms and conditions listed herein. In the event that a winning bidder does not perform within the terms of this contract, the auctioneer may, in addition to all other remedies allowed by law, retain all monies received as deposit or otherwise as liquidated damages. Articles not paid for and removed within the announced payment and removal times may be resold at public or private sale without further notice, with no reserve; any deficiency, together with all expenses and charges of resale, including legal fees, will be charged to the defaulting purchaser.
***AMENDMENT/ADDENDUM TO TERMS AND CONDITIONS OF AUCTION: Any amendment or addendum to the terms and conditions of the auction will be announced by the auctioneer prior to the start of the auction and will supersede the applicable terms and conditions listed herein.
