Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. Under no circumstance shall bidder have any kind of claim against Rubber City Classic or anyone else if the Internet service fails to work correctly. Rubber City Classic reserves the right to withdraw or re-catalog items in this auction. If you are the successful bidder, there will be a Buyer’s premium of 10% of the purchase price and full payment is due by 5:00 p.m. on the Monday following the auction. Vehicles must be removed by 5pm on the following Thursday after the auction or a $75/day storage fee will be applied and may be subject to impound. RCC does not guarantee inside storage and will not be responsible or liable for damage or loss to the Vehicle, including, but not limited to, theft or damage to the Vehicle, any of its components or its contents while on consignment. It is the purchaser’s responsibility to contact their insurance company immediately and obtain coverage on the Vehicle. By submitting your Proxibid, you agree to the above terms and conditions and promise to defend, indemnify and hold harmless RCC, its affiliates, shareholders, officers, employees, representatives and agents along with the employees, agents or affiliates of the auction and against any and all claims, demands, losses, damages, liabilities, judgments, costs and expenses whatsoever (including the reasonable cost of investigating and defending against any such items, and reasonable attorneys’ fees incurred in connection therewith), incident to any claim, whether baseless or well founded, by any third party directly or indirectly connected to any Vehicle taken by RCC on consignment, in any way arising out of, related to or resulting from: (i) property damage, injury, illness and/or death caused, in whole or in part, by the acts or omissions of Consignor; (ii) any breach by Consignor of any representation or warranty set forth in, or made by Consignor pursuant to, the purchase of this Vehicle; or (iii) any default in the performance of any of the covenants or agreements made by Consignor in, or pursuant to, the purchase of this Vehicle including without limitation any claim for taxes by any State of the United States, territory or political subdivision thereof. Sales tax may be due at time of purchase if vehicle is being offered by a licensed auto dealer. Sales tax amount will be determined by buyers location.
