Prospective buyers are advised that each and every item or lot will be sold to the highest bidder for cash or it’s equivalent.
The balance of purchases and fees will be due prior to pick up or release of the items or lots. If no purchases are recorded, or if high bids are rejected by selling agency, any money placed as a deposit will be refunded to buyer.
No Personal checks accepted - No Exceptions. Cash or Certified Funds are the only accepted method of payment.
C. B. Kaye & Associates expressly reserves the right to determine the manner of conducting the auction and the right to sell items or lots by individual or group lots as it deems appropriate.
C. B. Kaye & Associates assumes no liability for errors or omissions in this or any other listing.
The buyer acknowledges that they or their agent has inspected all items which they will be bidding on or eventually purchasing.
Buyer agrees to accept items purchased “AS IS, WHERE IS, WITH ANY AND ALL FAULTS” and “WITH NO WARRANTIES OF ANY KIND”. The auctioneer expressly disclaims for itself and as agent of any seller any warranty as to fitness for particular use or merchantability of all items offered.
The buyer expressly waives any claim in respect to any possible future use of any item purchased for any purpose whatsoever. The buyer does hereby assume and does agree to indemnify and hold the auctioneer, his agents and any sellers harmless from any and all future claims or liability.
Some assets may be offered subject to approval of secured parties, U.S. Bankruptcy Court, U.S. Marshal Service, Banks or Bailiffs of the Circuit or District Courts. In Bankruptcy auctions, all machinery, equipment, inventory and or Real Estate shall be offered in bulk subject to piecemeal bids and subject to the U.S. Bankruptcy Court’s approval.
Where approval is required, announcements will be made at the time of or prior to the start of the sale. Any terms announced at the time of sale shall supersede any item listed above. Some Items may be offered for sale with Reserve or Minimum Bid Requirements.
NOTHING MAY BE REMOVED UNTIL THE BUYER HAS PAID IN FULL.
ALL GOODS TO BE REMOVED AT THE RISK AND EXPENSE OF THE BUYER, PLEASE BRING YOUR OWN EQUIPMENT AND ASSISTANCE FOR REMOVAL OF ITEMS. ITEMS MAY BE LOADED BY THE SELLER AT THEIR DISCRETION. ALL BUYERS AND CONTRACTORS USING EQUIPMENT TO REMOVE ITEMS MUST SHOW PROOF OF LIABILITY INSURANCE.
BILLS MUST BE PAID IN FULL NO LATER THAN MONDAY 05/19/08 BY 4:00 p.m.
ALL ITEMS MUST BE REMOVED BY 4:00 P.M. WEDNESDAY 05/21/08.
FAILURE TO REMOVE ITEMS BY POSTED DATE WILL RESULT IN FORFEITURE OF ANY MONEY POSTED AGAINST THE ITEM. UNCLAIMED ITEMS MAY BE LIQUIDATED AFTER THIS TIME TO SATISFY UNPAID BALANCES.
HIGH BIDDERS MUST POST A 25% DEPOSIT OF THE TOTAL PURCHASE PRICE UPON COMPLETION OF THE AUCTION IF THEY INTEND TO LEAVE THE AUCTION PRIOR TO FULL SETTLEMENT OF ANY INVOICES.
Removal Schedule: Day of Sale: to 4:00 p.m.
05/19/08 – 5/22/08: 10:00 a.m. – 4:00 p.m.
Failure to remove items within the listed times, whether paid or not, shall make any deposits subject to forfeit.
