1. This is a public online auction, conducted by Scofield Auctions, Inc. (the Auctioneer). The principal auctioneer is Stephen H. Schofield, NH #2272.
2. Payment Instructions: Bidders must register for this auction with a Visa, MasterCard or Discover that will be charged for the purchases made, plus Buyers Premiums, and shipping & handling fees within 48 hours of the conclusion of the sale. 3. There will be no sales tax charged for online sales.
4. Scofield Auction, Inc. has put forth every effort in preparing the catalog for this auction to provide accurate descriptions of all items. All property is sold "as-is, " and it is the bidder's responsibility to determine the exact condition of each item. Printed statements or descriptions by staff are provided in good faith and are matters of opinion. Absolutely NO refunds will be offered.
5. This auction is being conducted under appropriate State and Local laws and the Uniform Commercial Code. Any additional terms or conditions of sale shall be announced before the auction. Bidding on any item indicates acceptance of these terms and conditions.
6. Registration: When you go to the auction catalog, just click on the "Register" button at the top of the page. It may take a few minutes to register, so allow yourself some time before the auction begins to complete the process. You will need to place a credit card on file for verification, and in case you choose to use the card to pay for your purchases. Proxibid does not charge a fee to register. You only need to register once with Proxibid to be able to bid in all future auctions.
7. To better serve our customers, all bidders must provide their name, address, daytime phone number, and email address at which they can be contacted. This is to ensure effective communication between Scofield Auction, Inc. and the bidder throughout any transactions.
8. Bidder's Duty to Update Information: Whether you are a new or returning bidder, you agree that if any of the information associated with your bidder number - including contact information- changes at any time prior to, during, or after this sale, you will notify the Auctioneer of the change by updating your bidder profile.
9. Conduct of Sale: All deposits, bids, and credits in this sale will be made in United States Dollars. You agree not to use any hardware, software, program, or system that would interfere with the orderly conduct of this sale. You further agree not to copy, reproduce, or publicly display any content from the Auctioneer's website without first obtaining written permission from the Auctioneer.
10. Closing: The Auctioneer's online auctions are designed to mimic traditional "live" actions. For this reason, this auction will have a staggered, dynamic closing.
a. Staggered Closing: This online auction will automatically begin to close at a rate of two items per minute, every minute. Items' closing times may be extended past their scheduled closing time, however, as a result of the Auctioneer's dynamic closing feature.
b. Dynamic Closing: The closing time of an item is automatically extended an additional two minutes whenever a bid is placed within the two minutes leading up to an item's scheduled closing time.
11. All accounts must be settled within ten business days.
12. Chargebacks Prohibited: You agree that you will accept all charges placed on the credit card associated with your account, and you agree that you will not charge back any amount that the Auctioneer charges to your credit card. You agree that this provision applies equally to amounts charged in connection with any items you have won and any costs or fees discussed in Paragraph 11 of these Terms and Conditions.
13. Shipping & Handling - All shipping will be via USPS flat rates boxes. This means they will ship Priority Mail. Rates are as follows:
Small Box 8 11/16" x 5 7/16" x 1 3/4" $7.15
Medium Box 11 1/4" x 8 3/4" x 6" or 14" x 12" x 3 1/2" $13.60
Large Box 12 1/4" x 12 1/4" x 6" $18.85
All boxes start with $50 of insurance. Sometimes additional postal services or insurance may be added to the invoice if needed, based on value, weight, size and destination. Please refer to USPS.com for more details. The actual cost of shipping, insurance, registry and tracking services is charged to the Bidder, plus a $5 packing/handling charge. We will not entertain shipment using lower classes of mail due to the increased risk of loss. Items will be shipped within five business days upon receipt of full payment, often much sooner.
14. The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. The purchaser also agrees that a fee of 2% per month will be added to the balance of any unpaid balance due the auction company and any other costs or losses incurred by the purchaser's failure to adhere to these terms. Any debt collection or dispute proceedings will be heard in Carroll County, New Hampshire.
15. All sales are final.
16. By bidding on any item, the bidder shows acceptance of the terms of the auction.
17. The auction company reserves the right to refuse service or decline registration to any person.
18. The Auctioneer reserves the right to withdraw any item before the sale.
19. The Auctioneer reserves the right to postpone the auction. No one may have recourse as a result of any postponement.
