Buyer’s Premium:
A Buyer’s Premium of eighteen percent (18%), will be added to the high bid for the purchased items and included in the total selling price paid by the buyer. For example, if the successful bid (the hammer price) on a given item is $100, the eighteen percent buyer’s premium will equal $18, and the purchase price for the item will be $118 (plus taxes, shipping, and handling). All property is sold 'AS IS', and ALL SALES ARE FINAL. Property is open to thorough public inspection or through the photos provided. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Atlantic Auctions, Inc., may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall Atlantic Auctions, Inc., be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. We do take a reasonable time to describe and photograph the items, but description may or may not describe all aspects of an item, and photos may or may not include any flaws in the item. We will never intentionally mislead, or omit anything that may affect the value or final price of an item. Shipping & handling costs are based on the weight, size of the package, materials & labor, not by what you paid for the items. Please keep that in mind.
1. CATALOG: All items in this Online Auction are selling AS-IS, without recourse, with NO warranties, NO guarantees, and NO refunds implied or otherwise by either Atlantic Auctions, Inc., or the Seller. Online bidders unable to preview items(s) are advised to obtain all information necessary PRIOR TO BIDDING to make an informed decision as to all conditions that may affect their decision to bid or amount to bid. No refunds will be made after high bid is accepted. Bidders enter into a binding contract and acknowledge all Terms & Conditions of the Auction. Atlantic Auctions, Inc. makes a concerted effort to include all information in the description of items. 2. BIDDER INSPECTION & RESPONSIBILITY: Bidders who bid online and do not attend the preview and inspect the items in person, acknowledge that the item may appear different when viewed online only. Bidder agrees that everything is sold as is, where is, without any express or implied warranties and that they may not return any item(s) they purchase. All Sales Are Final.
3. BIDDER REGISTRATION: All Online Bidders must register through Proxibid.com with their name, address, phone number, email address and credit/debit card so that Atlantic Auctions, Inc. may be able to communicate with Bidder on transactions, as needed. Atlantic Auctions does not sell this information.
4. PAYMENT: You will receive an invoice after the auction ends with confirmation of your purchases. Once invoices have been sent for your online purchase(s), payment by VISA, MasterCard or Discover will be charged within 24 hours after the conclusion of the Auction. Sales Tax on full purchase price (including Buyers Premium) will be charged as applicable. Payments are processed through Auction Payment Network (APN), a wholly owned subsidiary of Proxibid.com. NO CHARGE-BACKS ALLOWED. Any credit/debit card declined will be charged a $25.00 service fee, NO EXCEPTIONS.
5. CHECK OUT & REMOVAL: Pick-up can be made after payment is received, 9:00am to 4:00pm, Monday, June 19 through Thursday, June 22, 2017. No removal without prior payment. Items not removed by final posted date(s) will accrue a $25 per day charge per lot thereafter. Any item(s) not picked up per these and other terms stated above shall, at the Auctioneers sole discretion, be considered abandoned and will be resold or disposed of by the Auctioneer. No refund of such abandoned items will be made. Atlantic Auctions, Inc., will be on location where items are stored for removal. Photo ID is required at removal site. For items being picked up, purchaser is solely responsible for complete removal (i.e. crew, packing materials, etc.) and assumes all risk of loss, damage to or destruction of the purchased item(s). For items being shipped, Atlantic Auctions will be responsible for taking item to FedEx for shipping. Shipping Costs and insurance coverage for item during shipping is the responsibility of the winning buyer.
7. RESERVE: The auctioneer reserves the right to reject any and all bids. On lots upon which there is a reserve, the auctioneer shall have the right to bid on behalf of the seller.
8. CONDITION OF ITEMS SOLD: The auctioneer shall not be responsible for the correct description or completeness of photos’ authenticity, genuineness of, or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloging, or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold AS IS and without recourse. All expressed or implied warranties are waived. Photos provided have attempted to show any flaws in framing, pictures, etc., however, may not be inclusive of all defects.
9. TIME OF PAYMENT: All bills must be paid in full within 48 hours of the close of the sale. See Payment Instructions.
10. COMPLIANCE WITH SALES TERMS: Lots not paid for and removed within the time specified herein may be resold at public or private sale without further notice, and deficiency, together with all expenses and charges of resale, will be charged to the defaulting purchaser.
11: REMOVAL Upon the award of bid, and all risk of loss, damage to or destruction of the purchased item, passes to the purchaser and auctioneer shall have no liability whatsoever for any damage to or destruction of any such lots after they leave the premises of Atlantic Auctions, Inc.. PURCHASER SHALL MAKE HIS OWN ARRANGEMENTS FOR INSURANCE PROTECTION FOR ALL ITEMS PURCHASED.
12. NON-DELIVERY RESPONSIBILITY: Auctioneer shall not, in any event, be liable for non-delivery or for any other matter or thing, to any purchaser of any lot.
13. PERSONAL AND PROPERTY RISK: Persons attending during Preview or removal of goods assume all risks of damages of or loss to person and property and specifically release the auctioneer from liability therefore.
14. RECORDS: The record of sale kept by the auctioneer and bookkeeper will be taken as final in the event of any dispute.
15. LEGAL ACTIONS: Any debt collection or dispute proceedings will be litigated or arbitrated in Harford County, Maryland. In the event legal action is necessary to enforce any terms of this agreement, the prevailing party shall be entitled to reasonable attorney’s fees and expenses.
16. SELLER AUTHORIZATION: Seller authorized auctioneer or his clerk to execute sufficient memorandum of sale.
17. SHIPPING: All shipping is handled by FedEX, unless pick-up is arranged by winning bidder.
