If picking up locally, payment is required at time of pick up. If your items are being shipped, your credit card on file is charged via Proxibid's APN Network following the local pick up sessions.
TERMS OF PARTICIPATION:
ALL SALES ARE FINAL AND THERE ARE NO RETURNS. All Property is sold AS IS WHERE IS and ALL SALES FINAL. Please ask all questions BEFORE bidding. If you are unsure about an item, please do not bid, since all sales are final. We have time for personal inspection and/or will be happy to answer any questions to allow for a positive auction sale.
We take many photographs of the items, but for some items it is impossible to capture every minor defect. Bidders who bid from off site and do not attend the inspection understand and acknowledge that they may not be able to evaluate an item from photos as well as if they examined it in person.
LOCAL PICK UP: Pick Up is available at specified pick up date(s) and times only. If you wish to pick your items up you must notify Baileys Honor (following receipt of your auction invoice email) as all items are either pre-sorted prior to pick up or prepped for shipping. 3% Cash discount is available at local pickup (cash only - not checks).
INVOICE PROCESS: Approximately 1 hour following the close of the last item in the auction, you will receive and email with attached invoice from Baileys Honor. Your invoice will include your purchases, plus buyers premiums, and any taxes (if you are a Wisconsin resident)
SALES TAX: Wisconsin residents will pay sales tax based on location of auction (5.1% in Dousman, varies on location). Sales tax not charged if you do have a WI resale number on file with Baileys Honor. Out of state pick ups are required to pay Wisconsin sales tax unless you have a resale number on file also.

SHIPPING: Items being shipped are picked up but not released for shipping until payment has been processed. Shipper receives approval from Baileys Honor prior to shipping. Shipping is a separate transaction between buyer and shipper. We utilize UPS store. All items are shipped with insurance and tracking (no exceptions). We do not share credit card information! It is something you need to do directly with them for security purposes. Please take care of your shipping within 48 hours after you've received your paid invoice. Your invoice will include contact information for the shipper and when they will have your item(s).
NON-PAYMENT: Failed credit card attempts via the Proxibid payment network will be charged a $25 processing fee. If you are not picking up locally please make sure your credit card on file with Proxibid is up to date and has sufficient funds for your purchases. Credit card charge backs will not be accepted. All non-paying buyers are reported to Proxibid 7 days after close of auction and blocked for any future Baileys Honor auction transactions, and potentially all Proxibid auctions.
Baileys Honor reports all non-paying bidders to Proxibid no matter how small the invoice amount. These bidders are blocked from Baileys Honor's Auction and possibly all Proxibid auctions. Bailey's Honor reserves the right to block any bidders who are unable to comply with the terms/conditions/policies of our auctions.

Terms Of Sale
ACCEPTANCE OF TERMS. Bidding on any item, whether in person, by phone, by absentee bid or via an internet auction indicates the bidder's agreement to be bound by these Terms and Conditions for Bidders. Any right of bidder under this agreement shall not be assignable and shall only be enforceable by the original buyer. The rights and obligations of the parties shall be governed by the laws of the state of Wisconsin. All bidders submit to the personal jurisdiction of the state and federal courts in Wisconsin. Should a dispute arise between Baileys Honor Auction Estate Service and Bidder, Bidder waives any right to a trial or hearing in a court of law and agrees to settle the dispute through binding arbitration in Waukesha County, Wisconsin. Bidder agrees and grants that service of process on them may be obtained by mailing a certified letter, containing a summons, postage prepaid to them at the address they provided to register.

In no event shall Bailey's Honor Auctions be held responsible for having made or implied any warranty of merchant ability or fitness for a particular purpose. Bidder shall be the sole judge of value. The auctioneer reserves the right to withdraw any lot at any time before its final sale and to reject any bid for any reason. The highest bidder for each lot acknowledged by the auctioneer shall be the 'buyer'.
BUYER'S FEE. Buyers shall pay the final bid price of the lot, plus a buyer's fee for the lot equal to 18% of the final bid price for sales conducted via Proxibid. There is no sales tax charged for online sales unless you live within the boundaries of Wisconsin. If you live in Wisconsin sales tax will apply unless you have a resale number on file with Baileys Honor Auctions PRIOR TO THE SALE-NO EXCEPTIONS or it is the sale of tax exempt property. If Sales tax applies, it includes the entire transaction including the buyer fee.
SALES TAX. Buyers are required to pay any applicable state and local sales tax. Buyers picking up from out of state are required to pay sales tax. Sales tax rate is adjusted for location (county) of the auction.
WARRANTIES AND DISCLAIMERS.. All sales are final, with no returns or refunds. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinate factor. Bailey's Honor Auction Service shall endeavor to describe in detail each item and any pertinent information about it. Bailey's Honor Auction Service will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the items itself, Bidder agrees that everything is sold as is and that they may not return any item they purchase. Bidder further agrees that under no circumstances will he/she initiate a charge back on his/her credit card. Please ask all questions before auction and if you are unsure we ask that you not bid.
Baileys Honor Auctions is not responsible for any failure to execute a bid due to interruption of internet line service, premature closing of items, or human error. In the very unlikely event that there is a technical issue during the closing of an auction, auction company may reopen the action to complete bidding process for all parties.
Successful bidders will be added to future auction email notifications, and receive emails about upcoming auctions. Simple one time opt out is provided with each email, if you choose to discontinue receiving these.
