Terms Of Sale

This sale will be conducted by ServCorp International, Inc. (hereafter referred to as "Auction Company", ”Auctioneer” or “Auctioneers”). The auction is open to public, but all persons wishing to participate by bidding on any of the items must register for the auction and obtain a bid card number. By registering to bid, or by placing a bid, you agree to be bound by all of the following terms and conditions and any other announced terms and conditions of the auction in print &/or made by the Auctioneer at the auction on auction day: 1. All bidders must register and meet requirements with ServCorp International Inc. prior to placing a bid. Auction Company reserves the right to refuse any applicants bidding privileges and may revoke bidding privileges at any time. Some bidders may be required to place a deposit in certified funds. Deposit will be applied to total due if bidder is successful winning bidder on any item. Deposits will be returned within 48 hours of the close of an auction for non-winning bidders. Winning bidders who fail to complete payment in full by specified date will forfeit their deposit. 2. PAYMENT: 15% Buyer's Premium will be added to the high bid to arrive at the total bid price plus sales tax. All bids are final. All items are sold “as is, where is” no warranty. Full payment from internet bidders is due no later than 3pm on Thursday April 11th. We accept Cash, money order, cashier's check or wire transfer payable to ServCorp International, Inc. Sales Tax of 9.45% will be added to the purchase price, including buyer's premium, of all taxable purchases unless the buyer submits proof of exemption in a form that is satisfactory to the Auction Company and the appropriate governing authority. Proof of sales tax exemption must be provided prior to placing a bid. If sales tax is not collected and at a later date is determined due, buyer agrees that buyer will bear the liability of the sales tax for his/her purchase. 4. REMOVAL is by APPOINTMENT ONLY with 24 hours notice REQUIRED. Online Buyer’s will have until Thursday, April 25th by 3pm for removal of their purchases. No removal will be available on Wed/Thu April 17th or 18th and no removal on Fridays, Saturdays or Sundays is available. No items will be removed until paid in full. Disassembly, removal, shipping/transportation and all associated costs of the equipment and inventory purchased is the buyer’s sole responsibility. Buyer must supply their own handling equipment and personnel for removal. Please take this into consideration when placing a bid. The buyer must repair/replace any damage that occurs during removal. It is the buyer’s responsibility to secure all safety equipment to meet all applicable government safety standards in using or removing items purchased. Insurance may have to be provided to seller by trucking/loading company. Load out assistance may be provided on smaller items, but seller will not load heavy items and/or large equipment. Seller will assist in pushing item into place to load. Seller is not responsible for damage to equipment and/or buyer’s property if they do load. Some equipment may require modifications to meet import and safety regulations. For details and for information on your export obligations, please contact your customs broker. 5. Catalog is a guide only. All auction information provided in print, oral or image form was derived from sources believe to be true and correct, but is in no way guaranteed or warranted by Auction Company, Seller or Publisher. Auctioneer and seller make no representation or warranty, expressed or implied, on the items for sale and do further state the items are to be sold “AS IS, WHERE IS” WITH NO WARRANTY OR GUARANTEE. Auctioneers shall not be held responsible for any errors or omissions in the description of the merchandise. The buyer acknowledges that he/she is relying solely on his or her inspection, and accepts all responsibility for inspecting any item offered for sale. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Auction Company shall endeavor to describe the property in detail and any pertinent information about it; however in no event shall the Auction Company be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose including, but not limited to: year, make, model, serial number, VIN, hours, miles, condition, etc. Please note that hours and miles are meter readings only and may not have been verified. No sale shall be invalidated by reason of any defect or inaccuracy in any property being incorrectly described in sale catalog, any advertisement, or statements by Auction Company agents or employees. Bidders who bid from off site and are not present at the preview or auction understand and acknowledge that they may not be able to inspect the property as well as if they examined it in person. Buyer agrees that their bid is based entirely upon their own personal inspection and/or opinion of property being sold. Item descriptions that include "Starts", "Runs" or "Operates" means that the item was started with or without a jump upon assigning lot number; it is not a warranty or representation that the item will start, run, or operate at any time thereafter. Auctioneers are representing the Sellers’ interests in this transaction. Announcements made at the auction take precedence over any printed material or prior representations. 6. All items are being sold subject to reserve, which means if the reserve is not met the item will not be declared as sold. Auctioneer will accept the highest bid and the highest bidder shall be the purchaser subject to the reserve price being met. The Auctioneer shall designate the buyer after each item is auctioned. When auctioneer declares item sold, the buyer has entered into a contract and buyer assumes full responsibility for all their items. The auctioneer reserves the right to reopen the bidding if a dispute arises between two or more bidders even after declaring item sold. The original clerking sheet will rule after the auction. The auction records of the auction made by Auction Company shall be binding & conclusive to all parties. Auctioneer reserves the right to accept or reject any and all bids. All sales are final. The Auctioneer reserves the right to group lots, make lots smaller, or to add or delete at his sole discretion, as well as the right to offer individually and/or by group. 7. Buyer assumes full responsibility for all items purchased when the auctioneer declares it sold. Any winning bidder that does not pay for and remove item will not be allowed to register at future auctions and furthermore, items that are paid for but not removed will also cause same consequence for buyer. Auctioneer is not responsible for security of items purchased, which include lost, stolen or damaged items. Items left on the premises are at buyers own risk. The Auction Company reserves the right to resell any property that is not paid for in accordance with the terms as stated in this contract or any purchased property left at sale site beyond announced removal period at which point property shall be deemed abandoned. Such items may be resold without notice to buyer and the buyer shall be responsible to the Auction Company and Seller for any expenses of resale and collection and any damages resulting from the resale. All monies from any resale of items not paid for and/or abandoned shall be retained by Auction Company/Seller. 8. Unpaid bidders will be declared in default and will be subject to 20% fee per item based on bid amount (or $500.00 per item, whichever is greater) or forfeit whatever deposit may have been placed in order to receive bidding privileges. Buyer may be banned from future auctions due to non-payment. 9. There will be a $ 25.00 notary fee for all titled items and items requiring a notarized bill of sale. Once funds have cleared the bank a copy of title and bill of sale for each applicable item will be sent to purchaser for signature. Upon receipt of these copies back to the Auction Company the titles/bills of sale will then be sent by priority mail to the purchaser within 14 business days. 10. Internet online bidding is being provided as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Auctioneer shall have no responsibility for internet bidding interruption or delays beyond control. Internet bidders should be aware that due to the nature of the internet, delays in transmission could result in the auctioneer failing to recognize your bid. Auctioneer will work to accommodate varying internet speeds but is not responsible for the final result of delays. The auctioneer shall advance the bidding at his own discretion & in bid increments that is in best interest of auction. Under no circumstances shall Bidder have any kind of claim against Auction Company, seller or anyone else if the Internet service fails to work correctly before or during the auction. Auctioneer will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. ServCorp International, Inc. reserves the right to withdraw or re-catalog items in this auction. 11. All buyers and their guests enter auction site at their own risk and will indemnify and hold harmless the auction company, sellers and landowners from any current or future claim including but not limited to the fitness, use, damage, safety, injuries to persons or property that may have occurred during inspection, the auction or that may have been caused by or during removal or use of items purchased at auction site. Neither auctioneer nor Seller assumes responsibility for any accidents or loss due to theft, fire, vandalism, or personal injury. All minor guests must be accompanied by a legal guardian and are the full responsibility of that person. By registering and bidding at this auction, I swear and affirm that all information I have given is true and correct and that I have read and understand all of the terms and conditions of sale.
