Please be aware that you are about to participate in the auction of personal property, a type of sale much different than your purchase of items at a retail store or from another type of merchant. Auctioned items are purchased “as is”, with no return option.
All sales are final. Acceptance of a final bid by the auctioneer constitutes a legal, binding sales contract, pursuant to the terms and conditions stated herein.
1. Chuck Yarbro Auctioneers (CYA) has put forth every effort, in preparing the advertising for this auction, to provide accurate descriptions of all items, it is ultimately the Bidder’s responsibility to determine condition, age, genuineness, value, serviceability or any other determinative factor prior to bidding. Although CYA endeavors to describe in detail each item and any pertinent information about it, we will not be responsible for any errors or omissions in the description of the merchandise. Bidder agrees that everything is sold “as is, where is” and not subject to return under any circumstances. Rely only upon your own inspection/judgment, as that will be the only assurance you will have as to the condition or quality of the property or the number of items in the auction lot you may purchase. 3. Items become the Purchaser’s responsibility at the time the ‘gavel falls’ or when the auctioneer says “Sold”. All purchases must be removed from auction site by 4:00 p.m. Tuesday, November 21. If you are using a trucking company, it will be your trucker’s responsibility to insure, load and transfer the purchased item(s) to agreed upon location by the above required time.
4. To enable customers to participate in our auctions without the travel expense and lost time, purchasers will pay a 3% buyer's premium on the purchase price $1,000 and over. 10% on a purchase price of $999 and under. Example: If you buy a $50.00 item, your total purchase price is $55.00 ($56.50 if paid by credit or debit card). Please note, sales tax will be charged on the initial purchase price of $50.00, not on the $55.00 (Also see paragraph 3 on shipping.)There is no fee to register, watch, listen or to bid. Washington State sales tax is charged at the rate of 7.9%
5. Our on-line auctions move quickly! If you are interested in an item, bid quickly. If you are the successful bidder for an item in the auction you will be notified by Email immediately. Register early to assure your approval for bidding at the auction.
6. In order to better serve our customers, all bidders must provide their name, address, daytime phone number, and Email address at which they can be contacted. This is to insure good communication between Chuck Yarbro Auctioneers and the bidder throughout any transactions.
7. Purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. The purchaser also agrees that a fee of 2% per month be added to the remainder of any unpaid balance due the auction company and any other costs or losses incurred by the purchaser’s failure to adhere to these terms. Any debt collection or dispute proceedings will be heard in Grant County, Washington.
8. The auctioneer has the sole discretion to advance the bidding and may reject a nominal advance, should it, in his estimation, prove injurious to the auction. The auctioneer shall be the final judge in all bidding disputes and shall name which bidder is the purchaser.
9. The auction company shall not be held responsible for any “missed” bids or bids unseen by the auctioneer from any source. CYA is providing Internet pre-auction and live bidding as a service to our Bidders. Bidders acknowledge and understand that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against CYA or anyone else if the Internet service fails to work correctly before or during the live auction.
10. By registering for the auction & bidding on any item, the bidder shows acceptance of the terms of the auction.
11. The auction company reserves the right to refuse [approval to bid] anyone deemed to be a potential detriment to the conduct of the auction
12. All announcements made day of auction take precedence over any and all printed or verbal statements.
