Terms Of Sale
1) EVERYTHING MUST BE PAID IN FULL on the date of the auction before buyer leaves the premises.
2) TERMS OF AUCTION: Payment for purchases must be made by cash (on site only), credit card, or cashier’s check. All cashier checks will be made payable to 'CrossBid, LLC'. All sales are subject to sales tax laws. Wire transfer information is available for Bidders with an invoice total of $20,000 or more. The Bidder agrees not to stop payment on any charges.
3) NO WARRANTY: EVERYTHING will be sold 'as is, where is', with no guarantees of any kind regardless of statement of condition made from the auction block. Buyers shall rely entirely on their own inspection and information.
4) The Bidder is responsible for knowing which item he is bidding on. If he is unsure, he should inquire or not bid. When you become the winning bidder at auction you have entered into a binding contract and will be expected to pay for items in which you were evidenced to be the successful bidder. Auctioneer will not honor 'mistakes'
a. Many Lots will be sold as Times the Money. This means that the value of your bid will be multiplied by the quantity shown in the catalog. You will see “Bid Price x __” within the catalog description to indicate this.
5) RECEIPT: Buyer will be furnished a receipt when payment is received for items purchased. This receipt must be presented to and validated by check-out personnel before the buyer will be permitted to remove purchases from the auction premises.
6) REMOVAL DATE: Every effort is made to 'guard' merchandise throughout the auction however the merchandise becomes the full responsibility of the buyer when the Auctioneer says 'Sold,' and the buyer assumes all risk of loss and damage to property until removed from auction premises.
7) ANNOUNCEMENTS: All announcements made day of sale take precedence over printed material. List subject to change at any time, catalogs and sale bills are only guides to help you during the auction, they are subject to error.
8) DISPUTES BETWEEN BIDDERS: The Auctioneer shall designate the Purchaser after each item of merchandise is auctioned. If a dispute arises between two or more bidders, the auctioneer reserves the right to reopen bidding. His designation of a buyer shall be final.
9) INJURY AND DAMAGE: Bidder acknowledges responsibility for any personal injury or property damage caused by bidder or his agent and further agrees to hold CrossBid LLC, the owner, its officers, or employees harmless for any personal injury to himself or his agents and any property damage incurred on sale premises.
10) RETURNED CHECKS: All returned checks are subject to a $25.00 fee.
11) BUYER'S FEE: A 15% Buyer's fee will be in effect for this auction. An additional 3% will be added to those buying online.
