ACCEPTANCE OF TERMS: Bidding on any item, weather in person, by absentee bid or via an internet auction indicates the bidder's agreement to be bound by these Terms and Conditions for Bidders. Any right of bidder under this agreement shall not be assignable and shall only be enforceable by the original buyer. The rights and obligations of the parties shall be governed by laws of the state of Illinois. All bidders submit to the personal jurisdiction of the state and federal courts in Illinois. Should a dispute arise between Lowderman Auction & Real Estate and Bidder, Bidder waives any right to a a trial or hearing in a court of law and agrees to settle the dispute through binding arbitration in McDonough County, Illinois. Bidder agrees and grants that service of process on them may be obtained by mailing a certified letter, containing a summons, postage prepaid to them at the address they provided to register. TERMS OF SALE: All Property is sold AS IS, WHERE IS and ALL SALES ARE FINAL. Please ask all questions before bidding. If you are unsure about and item, please do not bid since all sales are final. We will be happy to answer any questions to allow for a positive auction sale. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinative factor. Lowderman Auction & Real Estate may attempt to describe or attribute merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall Lowderman Auction & Real Estate or our staff be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. The auctioneer reserves the right to withdraw any lot at any time before its final sale and to reject any bid for any reason. The highest bidder for each lot acknowledged by the auctioneer shall be the "Buyer". BUYER'S FEE: Buyer's shall pay the final bid price of the lot, plus a buyer's fee for the lot equal to 15% of the final bid price for sales conducted via Proxibid. There is no sales tax charged for online sales. WARRANTIES AND DISCLAIMERS: All sales are final, with no returns or refunds. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. Lowderman Auction & Real Estate shall endeavor to describe in detail each item and any pertinent information about it. Lowderman Auction & Real Estate will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the items itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase. Bidder further agrees that under no circumstances will he/she initiate a charge back on his/her credit card. Please ask all questions before auction and if you are unsure, we ask that you not bid.
