Terms Of Sale

PROPERTY-SPECIFIC TERMS OF SALE: Terms of Sale: The Appenzeller farm will be sold in two tracts, using the “buyer’s choice” method of sale. The highest bidder will be given the opportunity to select one or both tracts for purchase. Should they only select one, an additional round of bidding will take place for the remaining tract. Both tracts are being sold “as-is”. The sale of these properties are being made with no financing, appraisal, or inspection contingencies, and are being sold “as-is”, with no warranties or guarantees. The successful bidder(s) will be required to execute a real estate sales contract immediately following the sale. Non-refundable earnest money, equal to 10% of the purchase price, will also be collected from the successful bidder(s) on the day of the sale. Both tracts are being sold subject to a farm lease for the 2020 farming season. The seller has served a termination notice to the tenant farmer that will take effect immediately following the 2020 harvest. The new owner(s) will receive a credit at closing for the 2020 cash rent, in the amount of $150.00/acre, and subsequently, they will also be responsible for the entirety of the 2020 property taxes, payable in 2021. Closing will take place on, or before, June 30, 2020, at the law office of Benckendorf & Benckendorf in Morton.
