AUCTION TERMS
All property (items/lots) is sold “AS-IS” and it is the bidder’s/buyer’s responsibility to determine the condition of each item. Printed statements or descriptions by Stouffer’s Auction Co., Inc. are provided in good faith and are matters of opinion. The catalog for this auction is intended to provide accurate descriptions of the items/lots. In the unlikely event that an interruption of internet service occurs, the auction may continue, every effort will be attempted to restore service. Any tort, civil, or other type law suit filed by Bidder and/or Buyer against the Auctioneer, Auction Company, and/or Seller shall be filed in Washington County, Maryland, U.S.A. Bidder/buyer waives venue for filing such law suit(s) in any other jurisdiction. Credit card payment may account for a maximum amount of $5,000.00 for this auction. If your total purchase(s) exceeds $5,000.00, a wire transfer for the total amount to the bank designated by Stouffer’s Auction Co., Inc. shall be executed (deposited). A hold on your credit card for the total purchase regardless of amount may be transacted until your bank wire transfer is received. If, after five (5) business days your bank wire transfer is not received, your credit card hold transaction plus five additional percent (5%) shall be debited. Your credit card that you register will be charged for your purchases/debits and a pre-auction verification of that credit card shall be performed. All purchases must be settled by credit card (full payment or hold transaction) at the conclusion of the auction in U.S. dollars. No items will be shipped until full payment has been verified. Nothing will be charged to your credit card until a purchase is made. ONLY bank wire transfer, Visa & MasterCard credit cards will be accepted for on-line buyers within the United States. ONLY bank wire transfer will be accepted for on-line buyers out side the United States (five business day rules for credit card hold/transaction shall apply). Buyers shall be responsible for additional charges (if any) for bank wire transfer fees. Sales tax on items/lots purchased by non-Maryland residents will not be collected. Non-Maryland residents are responsible for submitting their own sales tax if applicable. Sales tax of 6% applies to Maryland residents unless you submit a valid Maryland Sales & Use Tax License, and accumulate a total minimum purchase (bid price + buyers premium) of $200.00.
To enable on-line buyers to participate without lost time and travel expense (motel, transportation, etc.) on-line buyers will pay an 18% buyers premium on the final accepted bid. For example, if you buy a $100.00 item/lot, your final purchase price will be $118.00 (100.00 + 18.00 = 118.00). Items/lots may be sold by the ‘choice’ method (high bidder may select one, several, or all of the items/lots offered) by multiplying the finial bid times the number of items/lots selected. All registered bidders must provide their name, address on credit card billing statement, daytime phone number, email address, and contact address to receive delivery of items shipped by the U.S. Postal Service (signed receipt required). Shipping and insurance cost (insurance equal’s total of purchases) is the responsibility of the buyer and shall be charged to your credit card as a separate transaction. Auctioneer has sole discretion to determine bidding increments and procedures. Auctioneer shall be the final judge in any disputes. Auctioneer/Seller may decline or counter any concluding bid. All sales are final, no refunds or exchanges. Announcements made day of auction take precedence over any and all previous written or verbal statements. Bidding on any item demonstrates acceptance of the terms of this auction.

Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Stouffer’s Auction Co., Inc. shall endeavor to describe in detail each item and any pertinent information about it.
Stouffer’s Auction Co., Inc. will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase.
Stouffer’s Auction Co., Inc. is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Stouffer’s Auction Co., Inc. or anyone else if the Internet service fails to work correctly before or during the live auction. Stouffer’s Auction Co., Inc. will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins.
