NOTICE: All Bidders attending this sale agree that they have read and have full knowledge of these terms and agree to be bound thereby. IDENTIFICATION: All bidders are required to give full name, address, phone number and email address. A valid credit card (Visa or MasterCard) is also required. PAYMENT: All bills must be paid in full within 72 hours of sale closing. Either by cashier’s check or wire transfers. Internet Buyers fee of 3% will be added to all purchases. A buyer’s fee of 10% will be charged on all items selling for less than $ 1,000.00. COMPLIANCE WITH TERMS OF SALE: In default of payment of bills in full within the time therein specified, the auctioneer in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages. Lots not paid for and removed within the time allowed herein may be resold at public or private sale without further notice, and any deficiency, together with all expenses and charges of re-sale, will be charged to the defaulting purchaser. SALES TAX: Purchaser shall also pay all applicable New York Sales Taxes. Buyers from outside the State of NY will be exempt from sales tax if they provide proof, an approved tax exemption status form and exception certificates that are acceptable to the State of NY. BIDDERS: Bidders are to be held personally liable for any bids made with their Bidding Number. RECORDS: The record of sale kept by the auctioneer and bookkeeper will be taken as final in the event of any dispute. DISPUTE BETWEEN BIDDERS: If any dispute arises between two or more bidders, the auctioneer may put the lot up for sale again at once, and resell to the highest bidder. The auctioneer’s decision shall be final and absolute. REMOVAL: All purchases must be removed not later than Wednesday, Oct 8, 2008. Removal shall be at the expense, risk and liability of the purchaser. The auction company will have the option to remove and store any item not removed within the time allowed at the expense and risk of the purchaser. RESPONSIBILITY FOR NON-DELIVERY: Auctioneer accepts no liability for loss or damage whatsoever arising (including but not limited to cost of attendance of bidders at the auction) from any lots not presented for sale. RISK TO PERSON AND PROPERTY: Persons attending during exhibition, sale or removal of goods assume all risks of damage of or loss to person and property and specifically release the auctioneer from liability therefore. Neither the auctioneer nor his principal shall be liable by reason of any defect in or condition of the premises on which the sale is held. THE AUCTIONEER has described the lots in this catalog to the best of their ability and belief from information furnished by the vendor who shall alone be responsible for any error or misstatement, which there be. The Auctioneer undertakes no liability whatever with respect to any faults, deficiencies and errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any lot and all statements as to these matters whether contained in the catalog or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact.
