PAYMENT: Payment must be made prior to removal from the auction house. In house bidders must settle their accounts on the day of sale. Absentee, Telephone and Internet Bidders must make payment within seven (7) days. Failure to do so may result in forfeiture of items.
IN HOUSE PAYMENTS: Accepted in-house payment forms are cash, checks, (with Conestoga Auction's approval), money orders, traveler’s checks, Debit cards, Visa and MasterCard will be accepted. If payment is made with cash or check, the 3% discount will be applied to the buyer’s premium. No out of state checks will be accepted by the auction, unless there was prior given approval by Conestoga Auction.
INTERNET PAYMENTS: All invoices will be emailed to the buyers on the first business day following the auction. This invoice will include total purchase price and shipping costs per the UPS Store. The credit card on file with ProxiBid will be charged three business days following the auction for the total amount due including any shipping fees. If you would like to make other payment arrangements, the auction must be contacted the next business day following the auction. Items must be scheduled for removal from our auction facility within seven (7) days or be charged a monthly fee of 1.5% of the purchase price.

CONDITIONS OF SALE
Conestoga Auction Company, Inc. has made every effort to catalog and correctly describe the property to be sold, however neither Seller nor Auctioneer guarantee the authenticity or condition of any lot. All lots are sold ‘AS IS’ and should be examined prior to bidding. The Auctioneers reserve the right to make verbal corrections and provide additional information from the block at the time of sale. All sales are final.
Conestoga Auction makes no warranties or representations whatsoever concerning the fitness for use, safety to fire, or to store, or reliability, of any firearm, ammunition or parts of components thereof, whether antique or modern. Any use of any such lot is entirely at the user’s risk. Conestoga auction expressly disclaims any liability whatsoever for accident, injury or damage resulting to any person from the use or storage of any such lot.
All items are sold subject to Federal and State Regulations. Any lot number proceeded by an ‘R’ or ‘CR’ must be registered. If you purchase a lot with ‘CR’, and you have a Curio and Relics license, you do not need to register this lot. Gun registration is handled by Conestoga Auction Company. Modern handgun purchasers must be Pennsylvania residents at least 21 years of age and must have photo ID (driver’s license). Out of state residents must have an FFL or a licensed dealer in their state to receive UPS shipment on firearms. No firearms will be shipped to California. It is the buyer’s responsibility to know the state and Federal laws within their state or country. Conestoga Auction is not able to determine what countries will allow the importation of firearms, whether antique or modern. Buyer’s should obtain any permits or licenses to export/import the property prior to bidding at the auction, as Conestoga Auction will not cancel a sale due to the inability to provide proper paperwork.
Modern rifle and shotgun purchasers must be at least 18 years of age and be eligible to purchase firearms. There is a $2.00 State Fee for PICS (Pa. Instant Check System) approval for each individual purchasing a handgun and/or longarm. There is also a $3.00 Pa. State Computer Processing Fee for each registered longarm or handgun that is purchased, unless the buyer has an “FFL”. There will also be a $4.00 charge for a mandatory trigger lock required for each modern handgun purchased by non-FFL holders. These charges will be passed on to the purchaser in addition to the purchase price and the buyer’s premium.
All purchasers must register for a buyer’s number and provide satisfactory identification. Upon fall of the hammer or said sold, the title and responsibility for each item or lot passes to the purchaser. In case of a disputed bid, the Auctioneer, will determine the successful bidder or re-offer and resell the article in dispute.
A 13% Buyer’s Premium is added to each item sold at the Auction, with a 3% discount for cash or check payment. Live online bidders using Proxibid.com pay an additional 7% (a 20% total for Proxibidders only, with no cash or check discount). If you are a PA resident or you pick up your items at the auction center a 6% Sales Tax will be charged, except to persons with a current Dealer’s Sales Tax Exemption on file with the Auction.
ABSENTEE BIDS will be accepted with a 25% deposit by money order or certified check. This deposit is required for in-house bidding only, and does not apply to Internet bidders. Any such deposits will be refunded if the bid is not successful. In the event of duplicate in-house absentee bids, the first bid received will take precedence. In-house absentee bids will not be executed on items which are found to be other than described in the catalog. The auctioneer may reject any bid which he considers to be nominal and not commensurate with the value of the article offered. It is entirely possible to buy items by absentee bid for less than your top bid price as they are handled competitively. All bids are handled in competition with audience on an alternate basis. Due to uncertainties of bidding, a lot may sell to the floor bidder for the same amount as an absentee bid. To prevent this from happening, the absentee bidder can give Conestoga Auction the right to bid the next higher bid by placing a (+) sign after the bid price. Please note: Absentee bids are a service provided to our customers free of charge. Every effort is made to execute all absentee bids; however, you must know that this is not a perfect system, neither here nor at any other auction house. In the event of an error of omission or failure to properly execute absentee bids, the auctioneer shall not be held liable. All sales are final and must be paid in full immediately. Items must be inspected before leaving absentee bids.
INTERNET BIDDING: We are not aware of the Live bids in advance, but only during the time of the auction as they are forwarded to our computer. Conestoga Auction will not be responsible for any omissions, errors or slow communications on absentee bids. In the event of a tie bid with a floor bidder and an online bidder, the floor bidder will take precedence. The auctioneer's decision in this matter is final.
PHONE BIDDING: There are a limited number of phones available and will be issued on a first come, first serve basis. Phone bidding is available on items valued at $500.00 and up, to approved buyer's, however, arrangements must be made at least 24 hours before the sale. Phone lines are reserved for serious bidders only. Conestoga Auction holds the right to reject any phone bids that are submitted after the set deadline.

REMOVAL & SHIPPING: The Auctioneer reserves the right to hold merchandise purchased by personal check until the check has cleared the bank, if the Auctioneer deems such action necessary to protect his interest. If shipping is requested by the purchaser, all packing, insurance, and UPS shipping charges will be charged to a credit card. Conestoga Auction does not pack or ship any items in house. All items are sent through the UPS Store, a third party shipping company. Please note: if you are successful on items from our auctions, it could take up to three weeks until your items are received due to the volume of items that sell through the Internet. There will be a $5 handling fee charged in addition to the shipping charge from the UPS store for any bidders wishing their items to be shipped. Items must be scheduled for removal from our auction facility within seven (7) days or be charged a monthly fee of 1.5% of the purchase price.
