Bidders may pick up their merchandise at the auction location in lieu of shipping. Buyer is responsible for removal of purchases. Buyer is responsible for safe removal. All items MUST BE REMOVED BY 3pm Tuesday, February 15, 2022 without exception. Any items not picked up or shipped within 10 days of the auction will be donated or re-sold. Removal of the item(s) purchased here under shall be at the sole expense, liability and risk of the Buyer. Buyer is responsible for providing all labor, material, insurance and equipment (fork lifts, dollies, ladders, tools, etc.) to properly execute removal and Buyer shall comply with all applicable laws and regulations related thereto. Buyer is solely responsible to provide any personnel, equipment or material needed to pick up purchases and shall for the assume all responsibility for the removal of any item of property purchased at the same and any and all risks associated with such removal including, without limitations, the responsibility for providing licensed and bonded professionals to ensure proper water, gas and/or power disconnections, and full financial responsibility for any damage or liability to persons or property resulting from any negligent pick-up and removal. Auctioneer will not honor 'mistakes'. Full purchase price, Bidder's premium, must be paid in full by Monday, Jan. 16th, 2022 before the close of the business day without exception. All unpaid invoices will be reported to Proxibid.com. Winning bidder will be responsible for all costs for storage, removal and disposal of purchased items not picked up or left behind, no exceptions. Nothing is to be removed from the premises until it has been paid for. In the event that a dispute arises over the bidding, purchase, terms, conditions, or events of the auction, Rose Auction Group shall be entitled to recover, any and all cost, expenses, and attorneys fees incurred, not limited to all appellate proceedings or fees for the enforcement of terms of this contract. BETH ROSE AUCTION CO, LLC reserves the right to withdraw, pass, or re-catalog items in this auction, or cancel any winning bids. FOR INTERNET BIDDING-A 15% Buyers Premium is in effect for this auction for all Proxibid participants. State sales tax must be collected by State Law; where applicable, you will be required to pay such taxes. If exempt valid, current tax exempt form and licensing is required. If the buyer fails to fulfill their obligations herein, all deposits and payments made hereunder by the buyer shall be retained by Beth Rose Auction Co, LLC as liquidated damages. Buyer remains responsible for full purchase price, fees, taxes and any other fees incurred in the process of enforcing this contract. All sales that are subject to 6.0% FL state sales tax where applicable, must be paid at time of transaction closing. The decision of the Auctioneer is final and absolute. The record of sale kept by the Auctioneer will be taken as final in the event of a dispute. REMOVAL: All items must be removed from the auction site no later than the date specified in our terms. Removal shall be at the risk, expense and liability of the purchaser. No items can be removed without presenting proper evidence of paid bills of sale. Your credit card on file with Proxibid will be immediately charged for your purchases, plus 15% Buyer's premium, and any applicable taxes. No items shall be removed until payment is received in FULL. All sales are final.
