This sale is being conducted by ServCorp International, Inc. (hereafter referred to as 'Auction Company, Auctioneer or Auctioneers”). The auction is open to public and will have onsite and online bidding available. All persons wanting to place online bids must register through Proxibid with a valid credit card. All persons wanting to place bids onsite will register at auction site on preview or auction day. The way you register for this auction is how your vehicle paperwork is completed, if applicable. Please make sure your name and/or company name and address are correct. If you are a car dealer, please register with your company name. There is a fee for corrections after paperwork has been completed. PLEASE read the information in LOT 0 (information lot) as it contains important information regarding this auction. Winning Bids are not contingent upon financing; If you do not have money in hand to purchase items, do not bid, as you are legally responsible even if you cannot get financing. All items are sold 'As Is, Where Is' without warranty and with all faults/defects. All sales are final. Some items in this auction may be subject to reserve; if reserve is not met, item will not be declared as sold. Auctioneer reserves the right to accept or reject any and all bids. Buyer is responsible for knowing which item they are bidding on. Once auctioneer declares item sold to bidder, the buyer has entered a contract and assumes full responsibility for their items. The auctioneer reserves the right to reopen the bidding if a dispute arises between two or more bidders even after declaring item sold. The original clerking sheet will rule after the auction. The records of the auction, both digital and print, made by Auction Company shall be binding & conclusive to all parties. Auction Company reserves the right to refuse any applicants bidding privileges and may revoke bidding privileges at any time. A deposit in certified funds may be required if applicant does not meet registration requirements for online bidding. Deposit will be applied to total due if bidder is a successful winning bidder on any item. Deposits for non-winning bidders will be returned within 48 hours of the close of an auction. Winning bidders who fail to complete payment in full by specified date will forfeit their deposit, if any. If you work for the entity and/or entities that this auction is being conducted for, please check with your supervisor before you bid on any items, as most entities do not allow their employees to bid due to ethics issues. If you are a successful online high bidder, your invoice will be emailed after the auction has concluded. If you have not received it within a few hours after auction concludes please check your spam/junk folder. If you are an onsite bidder, your invoice will be generated at the auction site. Invoices can also be generated at auction site for online bidders as well. Payment can be made in person on auction day from 10A to 3P and Friday 3/18/22 from 9A-2P. FULL PAYMENT IS DUE BY 2PM on 3/18 in US Dollars payable to ServCorp International, Inc. via cash, money order, cashier's check, or Wire Transfer (Wire transfers must include $20 wire fee to cover bank fee), & Personal/Business checks up to $5,000. Any Personal/Business Check over $5,000 will only be accepted with a Bank Letter of Guarantee. No counter checks are accepted, checks must be pre-printed. Visa, MasterCard, Discover and American Express will also be accepted in person at auction location or through Proxibid with credit card on file. A 3% transaction fee is added to invoice total for all card transactions. No bank drafts accepted. The card on file with Proxibid will be processed for any invoice unpaid by 2pm on 3/18/22. A $25 fee will be assessed for all card transactions that are declined. 10% Buyer’s premium applies to all purchases and an additional 5% buyer’s premium applies to online bidders. Buyer’s Premium will be added on all purchases (ie. Onsite: $1,000+$100 = $1,100 or Online: $1,000+$150 = $1,150) plus notary fee and/or tax if applicable. Sales Tax of 9.45% will be added to the purchase of all taxable items sold. Sales Tax will be collected on final bid amount plus any buyer's premium. Buyers who purchase for resale must present their resale tax certificate prior to payment, however if sales tax is later determined to be due, buyer agrees to bear all the liability of the sales tax for their purchases and remit such tax to the Auction Company and/or sales tax authority. Any boat, vehicle and/or trailer, etc. having no title and listed as 'Scrap' or ‘Parts Only’ will be sold without paperwork and is a taxable transaction. A $25 Notary fee will apply to all items with titles and/or needing bills of sale. The notary fee is added at time of invoice for all vehicles, boats & trailers and/or any other item with title or that require a bill of sale. A valid photo I.D. is required to complete all notarized transactions at time of purchase. Completed title work will usually be available 1-4 business days after payment is received. However due to unforeseen circumstances, it could take up to a week after the auction before paperwork is available. If purchaser is from out of state upon payment clearing the bank, a copy of title and bill of sale for each applicable item will be sent to purchaser for signature. Upon receipt of these copies back to the Auction Company the original titles/bills of sale will then be sent by priority mail to the purchaser within 14 business days. If buyer is local, paperwork can be picked up from our auction site location. Although information is derived from sources believed to be true and correct, the auction company/seller makes no warranty or guarantee, expressed or implied, on the items for sale and shall not be held responsible for any advertising discrepancies or inaccuracies. No warranties are made as to the merchantability of any items or their fitness for any purpose. All counts are approximate. Items/vehicles may be wrecked, have dents, scratches, flat tires, tears, defects, missing catalytic converters etc. Although the lot description may not mention defects or missing parts, does not mean there are not any. Bidders who bid from off site and are not present at the preview or auction understand and acknowledge that they may not be able to inspect the property as well as if they examined it in person. Bidder must rely on their own inspection before bidding. Item descriptions that include 'Starts', 'Runs' or 'Operates' means that the item was started with or without a jump upon assigning lot number; it is not a warranty or representation that the item will start, run, or operate at any time thereafter. All items are sold 'AS IS, WHERE IS' without warranty and with all faults and defects. All sales are final. No item shall be removed from auction site until paid in full. Removal/Shipping is sole responsibility of the purchaser and purchaser must supply their own handling equipment for removal/loading. No dock or ramps are available at auction site. REMOVAL dates and times are stated in the checkout section. All purchases must be removed on or BEFORE 3PM on TUESDAY, MARCH 22, 2022. Offsite items, if any, will have removal times listed in lot description. No weekend removal unless otherwise specified. Any items not removed within the stated removal dates/times are considered abandoned and may be resold without notice to buyer and all monies from any resale of unpaid items and/or abandoned items shall be retained by Auction Company/Seller. For details and information on your export obligations, if applicable, please contact your customs broker. Auction Company represents the Sellers' interests in these transactions. Announcements made on auction day take precedence over any printed material and/or prior oral statements. Auction Company reserves the right to withdraw any item or re-catalog items in this auction. The Auction Company/Seller shall have no liability to the buyer of any lot for non-delivery of any purchased item(s), other than the return of the buyer's deposit or payment on the lot if applicable. When entering the auction site all bidders and their guests enter auction site at their own risk and indemnify and hold harmless the auction company, sellers and landowners from any current or future claim including but not limited to the fitness, use, damage, safety, injuries to persons or property that may have occurred during inspection, the auction or that may have been caused by or during removal or use of items purchased at auction site. Neither auctioneer nor Seller assumes responsibility for any accidents or loss due to theft, fire, vandalism, or personal injury. All minor guests must be accompanied by a legal guardian and are the full responsibility of that person. Any Covid-19 protocols in place at the time of the auction must be followed when on auction site. Auctioneer shall have no responsibility for internet bidding interruption or delays beyond their control. Internet bidders should be aware that due to the nature of the internet, delays in transmission could result in the software failing to recognize your bid. Under no circumstances shall Bidder have any kind of claim against Auction Company, seller, or anyone else if the Internet service fails to work correctly before or during the auction. Auctioneer will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins to close. NOTICE TO POTENTIAL BIDDER: By registering to bid online at this auction, Bidder acknowledges that in exchange for the opportunity to bid online in this auction via Proxibid, Bidder agrees to allow ServCorp International, Inc. to send to Bidder via email, notices about its upcoming auctions.
