POLK AUCTION COMPANY ABIDES BY ALL FEDERAL GUN LAWS PERTAINING TO THE SELLING OF FIREARMS. ALL BUYERS ARE RESPONSIBLE TO KNOW ANY STATE OR LOCAL RESTRICTIONS RELEVENT TO FIREARM OWNERSHIP. Accepted forms of payment include: Cash in person, certified check, money order, & wire transfer. Check payments must be OVER-NIGHTED OR PRIORITY MAILED to Auctioneer with a tracking # provided by e-mail to the auction company. (admin1@polkauction.com) Any check returned for insufficient funds shall incur a service fee of $50.00, as well as result in the breach of terms. If Buyer pays via wire transfer, an additional $25.00 fee for domestic wires will be assessed. If Buyer pays by credit card an additional 4% processing fee will be applied to invoice total. Removal of the purchase will not occur until the funds are confirmed, verified paid or Auctioneer's approval in writing. All costs, responsibility and risk of removal shall be borne by Buyer.
Items must be picked up within 15 days of the sale.
Shipping is available to lower 48 states. Packaging, shipping and insurance costs are the responsibility of the buyer. Shipping cost is $65 per long gun & $35 per hand gun PLUS INSURANCE. Insurance is MANDATORY and calculated using the amount of the hammer price per gun. Display cases will add to the shipping charges. GUNS will be shipped once complete information is received from purchaser’s FFL Dealer. THERE ARE NO EXCEPTIONS TO THIS RULE! ALL other shippable items will be shipped VIA UPS/USPS. Terms And Conditions: 1. All persons attending the exhibition, sale, or removal of merchandise assume all risks of damage to person or property and specifically release and indemnify Polk Auction Company Auctioneers from any liability.
2. All property is sold AS IS, and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the buyer’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Polk Auction Company may attempt to describe the merchandise in advertising, on the Internet and at the Auction but makes no representations. In no event shall Polk Auction Company be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. Buyer is required to have all firearms fully inspected by a reputable Gun Smith before firing. All advertising is derived from sources believed to be correct, but is not guaranteed. All reloaded ammunition is sold ‘as-is’ with extreme emphasis on buyer beware.
3. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Polk Auction Company shall endeavor to describe in detail each item and any pertinent information about it. Polk Auction Company will not be responsible for any errors or omissions in the description of the merchandise. Bidder agrees that everything is sold ‘AS IS’ and that they may not return any item they purchase for any reason.
4. Polk Auction Company is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the Auction. Under no circumstance shall Bidder have any kind of claim against Polk Auction Company or anyone else if the Internet service fails to work correctly before or during the live auction. Polk Auction Company will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged are encouraged to use the feature on Proxbid and leave their maximum bid 24 hours before the Auction begins. Polk Auction Company reserves the right to withdraw or re-catalog items in this Auction.
5. The Auctioneer shall advance the bidding at his own discretion. Polk Auction Company may withdraw any item before or during the Auction. The record of the Auction made Polk Auction Company shall be conclusive.
6. When the Auctioneer says ‘SOLD’, Bidder assumes full responsibility for the merchandise. Everything MUST be paid for in full at the conclusion of the Auction. Payment shall be made by cash, check, or credit card. All applicable sales tax will be added to the purchase price of all purchases deemed taxable in accordance with Federal, State and/or Local Laws. Licensed gun dealers who are tax-exempt must submit a legible copy of your FFL Vendors License for verification. Otherwise, tax will be added to the sale if applicable. Unless exempted by law, the purchaser shall pay any and all applicable taxes. Bidder agrees to indemnify Polk Auction Company against any claim if sales tax is not collected on Bidder's purchases. Bidder agrees that under no circumstance will he/she initiate a chargeback on his/her credit card.
FIREARMS TRANSFERS:
7. All Firearms and Ammunition transfers will be in strict accordance with all International, Federal, State & Local Laws. Be sure to check your country, state & local laws before bidding. If you are unable to import, purchase or own a firearm or ammunition according to your residency laws, do NO bid on these items. If you bid and later find out you cannot legally own/accept delivery, the bid is still a valid contract and the buyer must pay. On-site, out of state buyers will be able to purchase and leave with any long gun(s) purchased; provided they can pass a NICS background check. Handguns purchased by out of state buyers are required to be shipped to a Federal Firearms License (FFL) holder in the buyer’s state UNLESS you possess a valid FFL license and provide a copy the day of the auction. Online firearm purchases are required to be shipped to a Federal Firearms License (FFL) holder in the buyer’s state UNLESS gun is a 1) muzzleloader, 2) you are a FFL dealer and we obtain a copy of your FFL, 3) it is an antique, 4) you have a Curio & relics license & the gun is at least 50 years old. Indiana residents that purchase items online can pick up their purchases at Polk Auction, or have their items shipped to am FFL dealer in their area. The same person to whom the bidder number is registered must be the person to pick up the firearm(s) at the conclusion of the sale. NO EXCEPTIONS. Federal Law disallows anyone else from accepting the transfer. All in-person purchasers are required to fill out a FORM 4473 unless you ONLY purchase an antique or muzzleloader, or have a valid FFL.
8. Shipping is available to lower 48 states. Packaging, shipping and insurance costs are the responsibility of the buyer. Shipping cost is $65 PER LONG GUN & $35 PER HAND GUN PLUS INSURANCE. Insurance is MANDATORY and calculated using the amount of the purchase. GUNS will be shipped via USPS Priority once complete information is received from purchaser’s FFL Dealer. THERE ARE NO EXCEPTIONS TO THIS RULE! Some items will NOT qualify for shipping & will be for pick up ONLY. They will be listed as pick-up only. ALL other shippable items will be shipped VIA UPS/USPS. You will be billed according to packaging and freight. We will do our best to pack items together to keep shipping costs down.
9. Polk Auction Company may refuse a buyer's number to anyone for any reason. Bidder agrees to provide any identification that Polk Auction Company may request, including but not limited to: driver's license, photocopies of credit cards, Social Security card, or Passport. Bidder agrees to comply with any stated additional terms or conditions associated with particular items.
10. We want you to be happy with your purchases! If you have any questions about the merchandise the time to ask questions is well in advance of the live auction. No returns are allowed.
11. All items not picked up during scheduled pickup times will be forfeited by the buyer.
12. Any controversy or claim arising out of, or relating to this contract, or the breach thereof, shall be settled and shall be heard and decided in Elkhart Co. Indiana.
