FIREARMS TERMS & CONDITIONS The terms of sale are non-negotiable. Registering to bid either live, online or absentee signifies your acceptance of the terms. Your bid is a binding agreement. Do not place a bid unless you intend to honor it. WARRANTY: • All merchandise sold “As Is, Where Is! with no warranty expressed or implied.” Watson Auction & Realty (hereinafter referred to as “The Auctioneer”) assumes no liability for any guarantee made by anyone. No warranty is made by the Auctioneer, either expressed or implied, as to the condition, merchantability, or fitness for intended use of any merchandise sold. • It is agreed that the Buyers have thoroughly examined the firearm(s) and merchandise to be conveyed and rely solely upon his/her own judgment in making an agreement to purchase. • There are no agreements, understandings or representations made by either the Seller, Auctioneer, or Auctioneer’s Representatives that are not set forth herein. • The Auctioneer does not pre-fire the firearms being offered to insure operability. • The Auctioneer makes every effort to accurately describe all firearms, merchandise, and accessories being offered. If any firearm, merchandise, or accessories have an obvious defect, the Auctioneer will make every effort to disclose the defect, but no such disclosure can be guaranteed. We are not firearms experts nor do we claim to be. • All information provided by the Auctioneer concerning the firearms, merchandise, and accessories being offered in this event has been taken from sources deemed to be reliable, but its accuracy cannot be guaranteed. • Firearms: Buyers are responsible for knowing the rules and regulations of the state in which they live pertaining to the ownership of firearms. ALL SALES ARE FINAL! If a firearm is purchased and the background check is denied or the firearm cannot be shipped to the buyer's state, the buyer is still responsible for payment of said firearm and the firearm will be sold at our next scheduled firearms auction and under normal contract. Descriptions are based on a visual inspection of the item. We have made no examination of any internal mechanical workings or firing mechanisms. You should have your firearms inspected and serviced by a qualified gunsmith. Firearms must be pickup up in person (pistol/revolver pickup available only to AL residents) or shipped to the FFL Licensee of the buyer’s choice. All shipping and insurance will be charged to the buyer and is calculated as the actual cost of shipping plus insurance at the USPS published rates. No firearm will be shipped until a signed copy of the appropriate FFL license is emailed to Watson Auction & Realty, LLC. The email to use is joe@watsonauction.net. Any cost of transfer charged by the buyer’s FFL licensee will be the responsibility of the buyer. If your state will not allow you to own certain firearms, please check the list of approved items BEFORE bidding. AGE REQUIREMENT: All Bidders must be 21 years of age to bid on firearms or relics in this auction. PAYMENT: Payment for Firearms, Merchandise, & Accessories shall be paid by Visa, Mastercard, Discover, American Express, U.S. Currency, or Cashier’s check w/Government Issued Photo Identification, • Credit Card purchases will incur a 3% upcharge. • (B) VISA, MASTERCARD, DISCOVER, AMERICAN EXPRESS. Card must be present and in users name. Bidder waives their right to initiate a charge-back on their credit card for any reason. In the event of large internet credit purchases and to reduce credit card fraud, Watson Auction & Realty, LLC will require copies of the Bidder's driver's license and credit card front and back. These documents can be emailed to joe@watsonauction.net. • Full payment shall be made on day of sale or as soon as possible thereafter. • All cashiers checks must be made payable to Watson Auction & Realty, LLC. • When payment is made by cashier’s check, Buyer agrees NOT to stop payment for any reason on all check(s) delivered to Watson Auction & Realty, LLC for settlement of auction purchases as all sales are final. • Watson Auction & Realty, LLC DOES NOT accept bank drafts. BUYER’S PREMIUM: • 15% Buyers Premium will be assessed on all Bidders for all Firearms, Merchandise and Accessories. SALES TAX: We are required by law to collect sales tax. The rate is 9% of the total purchase, less shipping and handling fees. We apologize for the inconvenience and added expense. If you are a business and supply us with your tax exempt certificate, taxes will be waived. The tax SHIPPING & HANDLING: • A $10.00 handling fee plus actual shipping charges will be charged on all merchandise requiring shipping. • All shipping will be facilitated through the United States Postal Service unless arrangements are made with Watson Auction & Realty, LLC prior to the shipping taking place. We make every effort to keep the shipping costs as low as possible. • All shipments will be insured for an appropriate amount at the Buyer’s expense. • All firearms will be shipped as soon as possible after the auction ends and we have received the FFL information from the Buyer. It may take up to 7 days for the firearms to ship. TRANSFER RESTRICTIONS: We WILL NOT transfer firearms to California, Hawaii, or Alaska. LOCAL PICK-UP TRANSFERS: • Col. Joe F. Watson is a Federal Firearms Licensee (hereinafter referred to as FFL). Before any firearm is transferred to your possession, you must fill out a 4473 and pass a background check. All background checks, transfers and related actions are required by Federal Law to be completed at our office located at 654 Lynn Jarvis Road, Dothan (Kinsey), Alabama. • If you purchase a weapon and are denied, you cannot bring someone else in to get a background check to facilitate the transfer. The background check is on the bidder only. If you are the successful high bidder and are “denied,” we reserve the right to place the firearm in the next available auction event and will resell it for you. You will be charged a 25% commission on the sale under these circumstances. If you make a profit, that is your good luck…if you do not, too bad, so sad. • HANDGUNS: If you are from a state other than the State of Alabama, we cannot transfer a handgun directly to you. You must provide the name and contact information for a FFL in your area, and the handgun will be shipped to the licensee at your expense. That licensee will have to transfer the handgun to you. You must be a resident of the State of Alabama to have a handgun transferred directly to you. If you are military personnel from another state and your permanent duty station is in the State of Alabama, Firearms can be transferred to you with a copy of your orders stating that Alabama is your permanent duty station along with Government Issued Photo Identification. OUT OF STATE TRANSFERS: • Anyone purchasing a firearm online will be required to furnish a Federal Firearms License to the Auctioneer to facilitate the transfer of the firearm. Firearms will be shipped to FFL’s only. • The Buyer is responsible for any fees charged by the FFL receiving the firearms on behalf of the Buyer. These fees are the sole responsibility of the Buyer. CURIO, RELIC, AND BLACK POWDER TRANSFERS: • Curio, relic, and black powder firearms may be transferred to the Buyer on-site or through the USPS without a background check. Any curio, relic, or black powder transfers will be at the sole discretion of the Auctioneer. POSSESSION OF FIREARMS: Buyers will not take possession of any firearms until payment has cleared the bank. If you pay by cash or credit card, we can convey the firearm as soon as possible after you fill out the appropriate paperwork and pass the background check on a day designated following the auction. FELONS: If you are a convicted felon, even if you have had your right to vote restored, you may not be able to own or possess firearms. Please do not bid on these weapons unless you have been issued a possessory number by the BATF. DOMESTIC VIOLENCE OR RELATED OFFENSES: If you have ever been convicted of a crime involving domestic violence, whether it was a misdemeanor or felony, you may not possess firearms under Federal Law. If you are currently under a restraining order or charges of any kind related to a domestic situation, you may not possess firearms under Federal Law. SHOTGUNS & RIFLES: We can convey long guns to you in the State of Alabama if you are from another state, provided that the long gun being conveyed is legal in the state where you reside. NON-U.S. CITIZENS: If you are not a citizen of the United States, it is incumbent upon you to be sure that you are in compliance with all federal requirements for firearms ownership prior to bidding on any firearms. DISCLAIMER: • All persons purchasing firearms must rely upon their own judgment and independent knowledge of the firearms and accessories they purchase and their individual circumstances when deciding to purchase the same.
