State Tax Laws**
Kentucky: 6%
• Lawn mowing equipment is NOT eligible for the farm machinery exemption.
• Construction equipment in Kentucky is NOT tax exempt.
• Kentucky law requires that farmers apply to the Kentucky Department of Revenue for an Agriculture Exemption Number to qualify for exemption from sales tax on qualified purchases.
Georgia: 8%
• Buyers from Georgia with a current Gate card will not be charged sales tax for eligible exempt equipment. Buyers from Georgia that don’t have a Gate card will be charged 8% sales tax.
Ohio: 5.75%
• Lawnmowers are NOT eligible for farm tax exempt in Ohio.
• Construction equipment is NOT tax exempt in Ohio.
• All eligible items sold from Ohio will be exempt from sales tax if they provide an Ohio ag tax form, otherwise Ohio 5.75% sales tax will be applied.
Tennessee: 7%
• Lawn Mowers are NOT tax exempt.
• Construction equipment in the state of Tennessee is NOT tax exempt.
• Buyers in TN must have a Tennessee Department of Revenue Application for Agricultural Sales and Use Tax Exemption.
• Tennessee will NOT honor certificates of exemption issued to farmers from other states. To make tax-exempt
purchases in this state, out-of-state individuals will need to apply for the Tennessee Agricultural Sales and Use Tax Certificate of Exemption.
Florida: 6%
• Machinery and equipment must be used at a fixed location in Florida. These exemptions are not allowed unless the purchaser furnishes the seller with a signed exemption certificate stating the item(s) purchased is for the designated use in agricultural production.
• Florida does not accept out-of-state certificates.
