Payment
Auction company will send out invoices after the conclusion of the auction. Please disregard any invoices generated from sources other than directly from Legacy Auction Services, LLC. Payment remitted based off any other invoice except auction company’s direct invoice, will not be honored nor considered legitimate in satisfying the terms of the sale. If you do not receive an invoice a few hours after the auction concludes, please check your spam or junk folder.
If you wish to claim a tax exemption, please notify us as such once you have received your invoice by returning the appropriate form completed to grant tax exemption. Once tax exemption is verified by Legacy Auction Services, LLC, an amended invoice will be sent out with taxes omitted from it. Texas Sales Tax is 6.75% and TERP Tax of 1.5% applies to those items possessing an off-road diesel engine of 50HP or greater. There will be no refunds granted for sales tax exemptions once payment has been remitted to the auction company. Therefore, tax exemptions will need to be made known prior to remittance of payments.
Payment is expected on the day of the auction for onsite buyers. Payment for online bidders is expected within 2 business days from the conclusion of the auction (Tuesday close of business). The preferred method of payment for online buyers is wire transfer.
We accept the following forms of payment: 1. Wire Transfer 2. Cash 3. APPROVED CHECK (with bank letter of guarantee – for those customers who do not have an established relationship with the auction company) 4. Credit Cards (accepted on invoices totaling $2,500 or less; subject to all applicable fees and taxes) will incur a 4% fee 5. ACH Transfer – will incur a 2% fee and items will not be released for pick up until receipt of funds are confirmed, cleared, and settled into the auction company’s account (anywhere from approximately 3 to 7 business days).
There is a tiered (compounding) buyer’s premium added to all purchases. Buyer’s Premium is 7% on the 1st $10,000 and 4% on the remaining balance. This is based on the onsite premium and online buyer’s fee adds 3%.
In person payments of cash and approved check will only be accepted on the 2 business days immediately following the auction (Monday and Tuesday). Again, wire transfer is our preferred method of payment for online buyers.
All sales tax for titled items (vehicles and trailers) will be paid at the time of registration in your respective county – not at the auction! All titled items may be assessed a $20 processing fee per item. Titles will be mailed out to the buyer’s address on file with the auction company within 10 business days from the date items are picked up from their respective sale locations.
IF PAYMENT IS NOT RECEIVED within 2 BUSINESS DAYS from the conclusion of the auction (Tuesday close of business), buyer will be reported for nonpayment and will be blocked from participating in any future auctions conducted by Legacy Auction Services, LLC as well as potential loss of bidding privileges altogether on the respective internet bidding platform.

This live and simulcast auction is presented on multiple online bidding platforms and is being held in a virtual manner as consignments are being sold from various locations. We are hosting a reserved auction and all items are sold as is where is without any warranties or guarantees expressed, implied, nor suggested as to the usefulness, condition, or merchantability of any given item and all items offered for sale are sold subject to seller confirmation. Legacy Auction Services, LLC makes every effort to accurately describe each item offered for sale in the auction within the auction’s catalog. However, all final judgements lie solely in the responsibility of the bidder and/or the bidder’s representatives. A winning bid recognized by the auctioneer and declared as “SOLD” is a legally binding contract entered into between the bidder and Legacy Auction Services, LLC as to which the bidder agrees, by registering to bid, to adhere to all terms and conditions of the sale.
