ACCEPTANCE OF TERMS. Bidding on any item, whether in person, by phone, by absentee bid or via an internet auction indicates the bidder's agreement to be bound by these Terms and Conditions for Bidders. Any right of bidder under this agreement shall not be assignable and shall only be enforceable by the original buyer. The rights and obligations of the parties shall be governed by the laws of the state of Wisconsin. All bidders submit to the personal jurisdiction of the state and federal courts in Wisconsin. Should a dispute arise between Hagenau Auction & Real Estate, LLC and Bidder, Bidder waives any right to a trial or hearing in a court of law and agrees to settle the dispute through binding arbitration in Waukesha County, Wisconsin. Bidder agrees and grants that service of process on them may be obtained by mailing a certified letter, containing a summons, postage prepaid to them at the address they provided to register. TERMS OF SALE. All Property is sold AS IS WHERE IS and ALL SALES FINAL. Please ask all questions before bidding. If you are unsure about an item, please do not bid, since all sales are final. We will be happy to answer any questions to allow for a positive auction sale. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinative factor. Items are not tested, please ask all questions before bidding. Hagenau Auction & Real Estate, LLC may attempt to describe or attribute merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall Hagenau Auction & Real Estate, LLC be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. The auctioneer reserves the right to withdraw any lot at any time before its final sale and to reject any bid for any reason. The highest bidder for each lot acknowledged by the auctioneer shall be the 'buyer'. BUYER'S FEE. Buyers shall pay the final bid price of the lot, plus a buyer's fee for the lot equal to 19% of the final bid price for sales conducted via Proxibid. SALES TAX. Buyers are required to pay any applicable state and local sales tax. Sales tax will be automatically calculated by atgPay at the time of checkout based on a variety of factors including: State, City & County jurisdiction requirements, shipping to address, shipping from address and category of item purchased, unless you have a resale number on file with Hagenau Auction & Real Estate, LLC PRIOR TO THE SALE-NO EXCEPTIONS or it is the sale of tax exempt property. If Sales tax applies, it includes the entire transaction including the buyer fee. WARRANTIES AND DISCLAIMERS.. All sales are final, with no returns or refunds. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinative factor. Hagenau Auction & Real Estate, LLC will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the items itself, Bidder agrees that everything is sold as is and that they may not return any item they purchase.
