Terms Of Sale
1. All purchases are to be paid in full within 24 hours of the auction ending. Acceptable forms of payment include Cash, ACH, Bank to Bank Wire Transfer, Certified Check and credit cards up to $2500 with proper ID, a 3% fee will apply to credit or debit cards. We will not automatically charge credit cards immediately after the auction.
2. To participate in this auction, you need to register and create an account on the bidding platform, Proxibid. As a security measure and to help identify you, they will require you to enter a credit or debit card. This account will allow you to bid on their platform and our auction. Anyone bidding on behalf of a third party must also register to bid and will be held responsible and liable for all purchases.
3. Kentucky State Sales Tax of 6% will be collected on this sale unless you have a valid State Issued resale certificate. You will also need to complete the KY Exemption form onsite.
4. All items sold are “as is, where is” without any expressed, written or implied warranty. Make your own value determination given any auction constraint prior to bidding. You are strongly urged to attend the preview.

6. Removal, once payment is received in full, will start Saturday the 23rd of September 9:00am to 5:00pm, Monday the 25th 9:00am to 3:00pm, Auctioneer under his sole discretion may extend this period on a case-by-case basis however the Seller is legally required to be out of this location before the end of the month. Any extension may result in fees being charged to recoup the labor of having to extend this period.
7. Once you are determined to be the winning bidder it is your responsibility to secure your items and insure them if they are worth insuring. The auction company nor the seller is responsible for providing security personnel for your items. If you have purchased smalls, we recommend that you are there early Friday and start your removal asap.
8. Buyer is responsible for any labor and equipment necessary to remove your items. Bring plenty of help to assist you. Remember you are solely responsible for their safety and conduct. If a situation arises because of your or their conduct, we reserve the right to have you escorted from the property. Should you require the use of moving equipment you are responsible for providing it including forklifts, carts, pallet jacks and such. There are several local tool rental companies that rent this equipment and will move it here for you for a fee.
9. Use of rigging companies, you can use any rigging company that maintains at least two million dollars in general liability insurance and conducts themselves in a professional workmanship like manner. We reserve the right to inspect such insurance policy and require the seller to be listed as a beneficiary. There are several local rigging companies available in the area.
10. Anything not removed by Wednesday the 27th will be considered abandoned by the buyer and disposed of by the Seller or his representatives as they see fit. No refunds or exchanges will be issued in any case.
11. By registering for this auction, you agree to allow us to contact you with auction notifications in the future via email, phone or text. We will not spam you and you can self-remove from our email list at any time.
12. A 15% buyer’s premium will be applied to the hammer price to determine the final bid price.
13. We may from time to time reach out to bidders to verify their accounts and bidding activity. We will attempt to contact you via email, phone call or have Proxibid staff reach out to you directly. In the event you are unavailable for this security check we reserve the right to freeze your bids or remove them entirely. Please make sure your account information is correct and that your phone number is one that you will answer should we need to speak with you.
14. The Auction Company nor Seller is responsible for any issues involving the auction platform, third party software or internet connectivity or stability. Do not wait until the last minute to place your maximum bid as it will be too late to assist you if you experience a problem. It is recommended that you bid from a desktop or laptop computer with stable internet connectivity. Cell phones can be used to bid however they are less reliable. Should you be bidding on multiple items at once, screen size will hinder your ability to do so, that’s why we recommend Desktop or laptop use.
15. Bidding on behalf of someone that has been banned from previous auctions will be grounds for immediate suspension of your bidding privileges and your previous bids may not be recognized under the sole discretion of the auctioneer.
16. Auctioneer or their staff reserve the right to bid on items they fully intend to own and pay for like any other buyer. Owners will not be bidding or buying, they are retiring after over 40 plus years in the business!
