By registering for and bidding at this auction, bidder acknowledges that they have read, understand and agree to all terms and conditions as stated for the auction. When the bidder is awarded the bid and declared the Buyer by the Auctioneer, the bidder agrees to pay for the items as required. ALL SALES ARE FINAL. This is a timed online only auction, with no onsite bidding. Each person wanting to bid online must register through Proxibid with a valid credit card. FULL PAYMENT IS DUE BY 12PM on Monday 3/4/24 in US Dollars payable to ServCorp International, Inc. Buyers may pay via cash, money order, cashier's check, or Wire Transfer, & Personal/Business checks up to $5,000. Any Personal/Business Check over $5,000 will only be accepted with a Bank Letter of Guarantee. Visa, MasterCard, Discover and American Express will also be accepted in person at auction location or through Proxibid with credit card on file. A 3% convenience fee is added to invoice total for all card transactions. No bank drafts or bank counter checks are accepted. The card on file with Proxibid will be processed for anyone not paid by payment deadline. Buyer's Premium of 16% will be added on all purchases (ie. $1,000 + $160 = $1,160 (plus tax if applicable) Sales Tax of 8.7% will be added to the purchase of all taxable items sold. Sales Tax will be collected on final bid amount plus any buyer's premium. Buyers who purchase for resale must present their resale tax certificate prior to payment, however if sales tax is later determined to be due, buyer agrees to bear all the liability of the sales tax for their purchases and remit such tax to the Auction Company and/or sales tax authority. All plastic pallets, basket crates, folding tables used to display items are not included in the lots, they are the property of the Auction Company and/or seller, unless otherwise stated. All items are sold "AS IS, WHERE IS" without warranty and with all faults. All sales are final. No warranties are made as to the merchantability of any items or their fitness for any purpose. All counts are approximate. Items may be damaged, have dents, scratches, tears, defects, crumbling plastic, etc. Although the lot description may not mention defects or missing parts, does not mean there are not any, buyer must rely on their own inspection before bidding. The seller & auctioneer reserve the right to reject any and/or all bids or remove items from auction. No item shall be removed from auction site until paid in full. LOCAL PICKUP ONLY. Auction company does not package or ship auction items. Removal/Shipping is sole responsibility of the purchaser and purchaser must supply their own handling equipment for removal/loading. Purchaser must supply their own boxes and bags for purchases. No loading dock or ramps are available at auction site. REMOVAL dates and times are stated in the checkout section. Removal will be on a first come, first serve basis. Due to the size of the facility, no more than 2-4 people will be checked out at any given time. Buyer will be paired with a ServCorp crew member to locate their items for removal. Any items not picked up within the stated removal dates/times are considered abandoned and may be resold/disposed of without notice to buyer and all monies from any resale of unpaid items and/or abandoned items shall be retained by Auction Company/Seller. Potential bidder and/or Purchaser does hereby indemnify and hold harmless the auctioneer and seller from any and/or all damages, claims or liabilities from injuries to persons or property of any type whatsoever caused during the sale or by the removal or shipping of items purchased. When entering any of the auction sites you do this at your own risk. Auction Company represents the Sellers' interests in these transactions. Announcements made on auction day take precedence over any printed material and/or prior oral statements. Auction Company reserves the right to withdraw or re-catalog items in this auction. Buyer is responsible for knowing which item they are bidding on. Once item has been declared sold, the buyer has entered into a contract and is responsible for the items. The Auction Company/Seller shall have no liability to the buyer of any lot for non-delivery of any purchased item(s), other than the return of the buyer's deposit or payment on the lot if applicable.
