For receipt of a registered bid number, the undersigned agrees that if his or her offer (highest bid) for equipment/property (items) is accepted by the Auctioneer, the following terms of sale are part of the formed contract between the Owner and/or Auctioneer (agent of Owner) and the undersigned buyer. Sales are final and the contract is enforceable when the Auctioneer accepts the undersigned’s offer. All items sell “As-Is, Where-Is” with no warranty. All sales are final. There shall be no guarantees or warranties, expressed or implied, statutory or otherwise, as to the merchantability or fitness for any particular purpose of any goods offered in this sale. The items are available to the public for inspection and any catalogs/ flyers/ads are merely a helpful guide, the buyer relies exclusively on his or her pre-auction inspection and each item is sold with all faults and defects therein. Descriptions, years, models, hours, miles are not guaranteed. No warranty is created by the representations of the Auctioneer. Bidders understand and agree that the Auctioneer has not created and will not create any express warranty to any Bidder as to the condition, performance or value of any of the items, products, or property being placed for sale that bidders may rely upon. Auctioneer reserves the right to refuse or withdraw a Bidder’s number. The Buyer shall take full responsibility and assume all risk of said equipment from the time Auctioneer accepts the final bid from the Bidder (Buyer). Buyer should guard their items accordingly. The Buyer has full liability insurance on said items as required by law. In the event of a dispute in bidding, the Auctioneers decision to settle is final. Auction Company/Auctioneers will neither be held responsible for accidents, nor errors/deletions or omissions on printed material. Purchases must be paid within 7 days of the auction end date and be removed from the sale site within 14 days of the auction date. All catalog/ad material is subject to change. Announcements made day of sale take precedence over catalog or advertising material. No credit or adjustments will be allowed in any form or amount. Owners or owner’s employees are eligible to bid on any items in this sale in accordance with the terms of the bidder contract. Auctioneer may bid on behalf of absentee bids and/or itself. Bidder acknowledges responsibility for any personal injury or property damage caused by Bidder and/or their party. Anyone under 18 must be accompanied by an adult. Any individual found tampering with machines in this Auction will be prosecuted to the fullest extent of the law. Settlement: The undersigned Buyer agrees to complete payment within 7 days of the auction end date in US funds. All checks require an irrevocable bank letter. Without an irrevocable bank letter or received payment by wire transfer funds, items cannot be removed until your check clears the bank. NO items will be released without proper settlement. Any money owed to Auctioneer may be deducted from any/all sale proceeds Auctioneer holds for undersigned representing a seller. Sales tax applies to all purchases unless we are provided with a Wisconsin Sales Tax Exemption Form. Buyer and undersigned do hereby consent to the US and state laws and penalties of failure to settle and pay. If Bidder (Buyer) fails to pay in full, Buyer: (a) authorizes owner and/or Auctioneer to resell such property at any time at public or private sale, (b) agrees to indemnify owner and/or Auctioneer against all loss or damage upon sale, together with cost and expense thereof, including attorney’s fees, and (c) agrees to pay Auctioneer interest of 1.5% per month on unpaid balance. Bidder (Buyer) responsible for any expenses due to collection of a bad check. In the event of non-payment of a bad check, the Auctioneer reserves the right to repossess, at any time, at your location, the equipment/property involved. Any dispute, Wisconsin law will prevail in Barron County court. Bidder (Buyer) accepts full responsibility for all purchases made and holds the Auction Company (Auctioneers) free from any liability including theft of items. Additional terms may be posted at auction site. Items left 15 days after the auction date a storage fee of $35 per item per day applies. Items will be considered abandoned after 30 days and become Hansen Auction Group’s property. The undersigned is bound by these terms. BUYER'S FEE WILL BE ADDED TO THE BID PRICE AND WILL BE POSTED ONLINE AND ANNOUNCED THE DAY OF THE AUCTION. PHOTOGRAPHY AND VIDEOGRAPHY WILL BE CONDUCTED FOR MARKETING MATERIAL. HANSEN AUCTION GROUP IS THE OWNER OF THE COPYRIGHTS TO ALL PHOTOS AND VIDEOS TAKEN.
