Terms of Sale Thank you for attending today’s auction! All items sell strictly AS-IS and WHERE IS. Details and descriptions are provided to the best of our knowledge. No warranty or guarantee is expressed or implied. Please inspect all items to your satisfaction prior to bidding as the will be no refunds, exchanges, or adjustments after the item is called sold. All buyers are responsible for their items from the moment that it is called sold. Please do not remove your purchases until the conclusion of auction and once payment has been made in full. All property is sold ‘as-is’ and it is the bidder’s responsibility to determine the exact condition of each item. Printed statements or descriptions by staff are provided in good faith and are matters of opinion. Registration: Anyone wishing to bid on items in the auction should register and obtain a bidder card. None bidding for an account other than their own must register as such. Auctioneer reserves the right to reject anyone who is not a registered bidder. A valid driver’s license is required to register. Buyer’s Premium: The Baldy Auctioneers, LLC charges all buyers 10% on all items. There is an additional 5% Internet Purchase Fee charged on all online purchases. Applicable State of GA Sales Tax will be charged on all Lots. Bidders exempt from Sales Tax must provide proof of an approved tax exemption status form and exception certificates that are acceptable to the State of GA prior to the close of the Auction. Payment: Payment in full must be made by Monday following the Auction in the form of Wire Transfer, Cashiers Check, or a Company Check accompanied with a bank letter of guarantee. Failure to arrange payment by this date means you are subject to being placed on our Delinquent Bidder List that is displayed on our Home Page. NO ITEMS leave until the payment is made in full. Unpaid Balances: The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. The purchaser also agrees that a fee of 15% per month be added to the balance of any unpaid balance due to the auction company and any other costs or losses incurred by the purchaser’s failure to adhere to these terms. Any debt collection or disputed proceeding will be heard in the state of Georgia. Removal: All purchases must be removed from the premises by Wednesday following the Auction during specified times. The designated pick up times will be posted under “Dates” on our website. If you are unable to pick up during this time, please make arrangements at least 1 week prior to the auction. Unless prior arrangements have been made, you will be charged a $50 fee to schedule an alternate pick up time. It is the buyer’s responsibility to provide adequate equipment and manpower to remove his or her items. If assistance is required, a fee may be incurred payable to Baldy Auctioneers. Items that have not been picked up within 10 Business Days following Auction will be considered abandoned, and no refunds will be given. No items may be removed until payments have been made in full. The Auctioneer and Proxibid.com accepts no liability for loss or damage howsoever arising (including but not limited to cots of attendance of Bidders at the Auction) from any Lots not presented for sale. Bidders are to be held personally liable for any bids made with their Bidding Number. All sales are final. The highest bidder for each Lot shall be the Purchaser, and in the event of any disputed the Auctioneers shall have absolute discretion either to settle such disputed or to re-offer the lot for re-sale. The Auctioneer may refuse to accept any bid that, in the auctioneer’s opinion, is not in the best interests of the seller. It is an offence against the Property, Stock and Business Agents Act 2002 for person to do any of the following as a result of a collusive practice, or to induce or attempt to induce another person by a collusive practice to do any of the following: to abstain from bidding or to bid to a limited extent only or to do any other act or thing that might prevent free and open competition. Severe penalties may be imposed on persons convicted of collusive practices. Anyone thought to be in violation will be escorted from the premises. The Auctioneer and Proxibid.com has described the Lot(s) in the catalog to the best of their ability and belief from information furnished by the Vendor(s) who shall be alone responsible of any error or miss-statement, which there may be. The Auctioneer and Proxibid.com undertake no liability whatever in respect of any faults, deficiencies and errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any Lot(s) and all statements as to these matters whether contained in the catalog or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact. The Buyer agrees to insure the Equipment purchased against all losses from the Auction Date until removal of the Equipment by the Buyer. Buyer holds Auctioneer harmless and not responsible for his purchased Equipment after it is pronounced sold to the Buyer. Each and every Lot is sold as seen. The Auctioneer and Proxibid.com provides no guarantees or warranties (express or implied) in respect of the Equipment contained in the Lot. All representations made by the Auctioneer and Proxibid.com, its servants or agents are to be considered lay opinions only and the Auctioneer and Proxibid.com accepts no liability for any purchase made by a Buyer in reliance upon them. The Buyer acknowledges he/she has read and agrees to be bound by the additional terms and conditions set forth.
