BUYERS PREMIUM EXAMPLE: $10,000 PURCHASE = $500 (10% WITH CAP) + $400 (4% INTERNET ONLY) FOR A TOTAL OF $900.00 BUYERS PREMIUM $2,500 PURCHASE = $250 (10%) + $100 (4% INTERNET ONLY) FOR A TOTAL OF $350.00 BUYERS PREMIUM TERMS AND CONDITIONS: 1)Kurtz Trading, LLC has described the Lot(s) in the catalog to the best of their ability. Kurtz Trading undertakes no liability with respect to any faults, deficiencies or errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any Lot(s) and all statements as to these matters whether contained in the catalog or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact. The Buyer has the sole responsibility with regards to verifying any and all information as it pertains to the Lot. 2)Each and every Lot is sold 'as is, where is'. Kurtz Trading provides no guarantees or warranties (express or implied) in respect of the Equipment contained in the Lot. All representations made by Kurtz Trading, LLC, its employees or agents are to be considered lay opinions only and Kurtz Trading accepts no liability for any purchase made by a Buyer in reliance upon them. 3)All lots sold during the Drive Thru portion of the auction will be sold with a ride and drive. The following are terms outlining the conditions of the ride and drive option: Ride and drive constitutes an operational engine, drive train, hydraulic functions. Ride and drive does not cover: wear of any type, oil leaks, batteries, tires, tracks, under carriage, cosmetic damage, electrical system, codes and warnings, etc. If an issue arises with an item, the buyer must notify auction management, on premise, immediately, at which time auction management and buyer will inspect item together for verification of issue. The issue must be agreed upon by both parties. Online bidders must exercise the ride and drive option at THE AUCTION FACILITY by the end of business on Wednesday following the auction. Online bidder’s not exercising ride and drive at the auction facility before taking possession of items purchased forfeit the right to the ride and drive option, NO EXCEPTIONS. The catalog is to be used as a guide only. Bidders are responsible for doing their own research and due diligence before bidding. Information is taken from sources deemed to be reliable. Catalog has been prepared by humans; thus, human error is always a possibility but never intentional. When available, serial number plates and hour meter/odometer pictures are provided for research purposes of potential online bidders. Year models stated are obtained from a 3rd party source deemed to be reliable and have not been verified by manufacturer, it is the sole responsibility of the potential bidder/buyer to verify year model through manufacturer before bidding. It is the buyer’s responsibility to do their own research on machine specifications, options, etc. as to the suitability of a particular machine for their application. Buying a machine that is not suitable for your application is not grounds for negating a transaction. Oral statements made on the day of auction take precedence over printed material. **RIDE AND DRIVE OPPORTUNITY ENDS ON WEDNESDAY, MAY 14th** **RIDE AND DRIVE IS VOID ONCE THE ITEM LEAVES THE AUCTION YARD** **AFTER THE RIDE AND DRIVE DEADLINE, KURTZ TRADING WILL NOT OFFER REFUNDS, REPAIR ASSISTANCE, FREIGHT ASSISTANCE, ETC.** **ONCE IT LEAVES THE AUCTION YARD, IT IS YOURS** 4)Items sold with issues for parts or repair are Sold AS IS. The Auction Company has announced all "Known Issues" with the items. However, issues discovered after the sale of the item does not negate the sale. The winning Bidder is Buying the item with all Known and Known Issues. 5)Bidders will be held personally liable for any bids made with their Bidding Number. Kurtz Trading, LLC. will not be held liable for internet connection issues, improper understanding of the bidding process, or accidental bidding. If you are the highest bidder, you are the owner. 6)There is a 4% Internet Buyers Premium charged to Online Bidders. Kurtz Trading, LLC. charges 10% on the first $5,000 for a maximum of $500 per item. Please do the math before bidding. 7)Applicable State of PA Sales Tax will be charged on all Lots unless you are exempt from Sales Tax and you provide a tax exemption form or exemption certificate that is acceptable to the State of PA. Kurtz Trading, LLC requires a NEW Sales Tax Exemption or Certificate for all auctions regardless if one was provided for a previous auction purchase. All invoices with a Sales Tax Balance Due will be considered Unpaid and the items will not be released. 8)Payment in full must be made by Friday, May 16th, 2025. After this date, Buyers will be considered delinquent and online buyers will be reported to the online auction provider. 9)All purchases must be removed from the premises by Friday, May 23rd, 2025. 10)The highest bidder for each Lot shall be the Purchaser, and in the event of any dispute the Auctioneers shall have absolute discretion either to settle such dispute or to re-offer the lot for re-sale. 11)The Buyer agrees to insure the Equipment purchased against all losses from the Auction Date until removal of the Equipment by the Buyer. 12)By bidding in this auction, the Buyer acknowledges he/she has read and agrees to be bound by the terms and conditions set forth.
