Sold Auction Company issues a bid number for auctions, and bidders are responsible for all purchases made using that number. The auctioneer can revoke this right or refuse bids at any time. Bidders must comply with all auction terms and are responsible for payments. Once a bid is placed, you acknowledge that you have read, understood, and agreed to these Terms. You are responsible for all bids made under your Bid Number, whether for yourself or on behalf of another. Sold Auction Company reserves the right to refuse service or decline registration to any person. Online buyers who fail to pay will be banned from all further bidding on any Sandhills products (ie. Equipment Facts, AuctionTime, etc.) until 10% of their invoice owed is paid to Sold Auction Co. Sold Auction Co. will inform Sandhills© and the ban will be removed. No future bidding will be allowed with Sold Auction Co. ever. CURRENCY TYPE: USD$ INTERNET BUYER’S PREMIUM: 12% ONSITE BUYER’S PREMIUM: 10% SALES TAX: Sales tax will be assessed by location & collected on Buyers Premium unless legal exemption documentation is provided at the time of the sale. OTHER FEES: A document preparation fee of not less than seventy-five dollars ($75.00) per Lot will be charged on all titled items Titles for purchased items will be delivered within 45 days after full payment. A document preparation fee will apply, and taxes may be collected unless exemption documentation is provided. Any bidders with credit cards that are declined on reconciliation day will be charged a $30 processing fee to run another credit card – NO EXCEPTIONS. SPECIAL TERMS: Bidders who bid from off-site & are not present at the live auction or preview equipment before the auction understand & acknowledge that they may not be able to inspect an item as well as if they examined it in person. Auctioneers reserve the right to group lots, reject bids, or withdraw items at any time. By registering for any auction, the bidder agrees to be added to the Sold Auction Co. email list. AUCTION SITE: The auction site is potentially dangerous, and bidders attend at their own risk. Once the auctioneer accepts a bid, the buyer assumes risk for the item and is required to obtain liability insurance if needed Bidders and any accompanying guest indemnify Sold Auction Co and Auctioneer against any claims or damages related to the purchase or use of auction goods. The auctioneer is not responsible for accidents or injuries at the auction site. RISK OF LOSS: After the auction, bidders bear all risk of loss. The auctioneer is not responsible for damage or loss once a bid is accepted. Late removals incur storage fees, and uncollected items may be resold. NO WARRANTIES: The Listing Catalog has been prepared as a guide only, based on information from sources believed to be reliable & from the consignor(s) of the Lot(s); however, its accuracy cannot be guaranteed or warranted. No sale shall be invalidated nor shall Auctioneer, its officers, directors, employees, agents, or attorneys be liable as a result of defects or inaccuracies in the Listing Catalog. 21. Auctioneer will make every effort to provide Bidder with information that is deemed to be accurate but in no way guarantees the accuracy of the information. Any clerking error or omission, printing error or omission, serial numbers or description discrepancies including make, model or year, fuel type, engine type or any other error or omission made by Auctioneer shall not invalidate any sale of any Lot. Bidder acknowledges that it is Bidders sole responsibility to verify make, model, year, fuel type, serial number or any other information that a Bidder deems necessary & Bidder has satisfied all inquiries prior to any bidding. DISCREPENCIES: Sold Auction Company shall not be held responsible for any “missed” bids or bids unseen by the auctioneer. The Auction may be recorded via digital audio &/or video recording. Should audio or video recordings become inaudible or damaged, the recorded results transcribed by the auctioneer clerk shall become the sole determining factor on the final lot price if a dispute arises over the sale price of a lot. The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. The purchaser also agrees that a fee of 2% per month be added to the balance of any unpaid balance due the auction company and any other costs or losses incurred by the purchaser’s failure to adhere to these terms. Any debt collection or dispute proceeding will be heard in Lexington County, South Carolina. ALL GOODS SOLD AT THE AUCTION ARE AS IS, WHERE IS, & WITH ALL FAULTS. THERE ARE NO GUARANTEES OR WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE GOODS. ALL WARRANTIES REGARDING SUCH GOODS, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTIBILITY & FITNESS FOR A PARTICULAR PURPOSE, ARE EXCLUDED.
