Terms Of Sale
TERMS AND CONDITIONS
The Buyer agrees by participating in any of Circle B Farm & Auction LLC (Circle B)
auctions and by placing a bid that the Buyer/Bidder accepts the terms and conditions
below and will be bound by them.
1. All purchases must be paid-in-full by Monday, June 23, 2025 3:00 PM central time by
cash, certified (official) check, bank wire transfer, and/or personal/business check.
Personal/business checks will only be accepted when the accompanying bank letter of
credit is written for the same account. If Buyer does not have a bank letter of credit to
accompany his/her check, the Buyer will not receive a paid invoice and items will not
leave the premises. Any invoice paid by bank wire transfer will have an additional
$30.00 added to the final invoice.
2. Load-Out Hours: Saturday until 6:00PM. NO LOAD-OUT ON SUNDAY. Monday, June
23, 8:00AM – Friday, June 27, 4:00PM. Any load-out after this date will be by
appointment only. All items must be picked up by Thursday, July 28th, 4:00PM. Any item
remaining after this date will be subject to a storage fee of $50 per item per day. Unless
other arrangements are made prior to this deadline, these item(s) will be sold for
storage fees in the next auction without notification to the owner.
3. Buyer's premium will be collected and retained by Circe B on each item at a rate of
10% capped at $1,500 per lot plus an additional 2% fee for bidding online. MS Sales
Tax (if applicable): 7% MS Farm Tax (if applicable): 1.5% w/Commercial Farmer Permit.
MS residents only – Appropriate sales tax plus $15 title fee {$45 if Fast Tracked} will be
added to the bid price and a title application will be provided within 10 business days.
4. Buyer assumes the responsibility for security of Buyer’s goods purchased and agrees
Circle B cannot guarantee the security of property. Should the Buyer leave any goods in
the custody of the Circle B, the Buyer does so at Buyer’s own risk. Furthermore, Buyer
releases Circle B from any liability for Buyer’s goods in the event of loss, damage,
unauthorized use by any person or theft of any such goods. Buyer acknowledges and
promises to maintain sufficient insurance to cover Buyer’s goods from the exact
moment the ownership interest transfers from Seller to Buyer (when the Auctioneer so
announces by the fall of the hammer or in a more normal matter of saying “sold”).
5. Any announcements made the day of the auction take precedence over any written
or advertised announcements, but do not alter, in any way, the terms and conditions of
the sale. Circle B shall decide any outcome or resale of any goods in dispute between
two bidders or more (tied bids).
6. Circle B makes no warranties (expressed or implied) to any party that extend beyond
the description provided by the seller of the goods. Any bidder receives the goods “as
is, where is” and “with all faults.”
7. Buyer holds Circle B harmless for any injury, damage, or loss connected with any
auction.
