Terms Of Sale
The conditions set forth below constitute the terms and conditions by which all property is offered for sale at Cook and Cook Auctions. Bidder agrees to be bound by the terms that follow, whether present at auction, bidding online or by absentia.
Bidders are required to register with proper identification prior to bidding and must use the number issued to them when bidding. Online bidders are required to register with Proxibid. Registering through Proxibid requires a valid credit card as a security measure.
All items are sold to the highest bidder as acknowledged by the auctioneer. The auctioneer has the right to reject any bid; to advance the bidding at his discretion; and in the event of a dispute, often referred to as a tie bid, determine the successful bidder or to re-offer and resell the item in dispute. Should a dispute remain subsequent to the sale, the final auction record will serve as conclusive. All sales are final.
Absentee bids will be executed for the convenience of the customer; however, the Cook and Cook Auctions and its employees will not be held responsible for any errors or the failure to execute bids.
The auctioneer reserves the right to withdraw any lot(s) prior to the sale. Some items offered may be offered with a reserve, a confidential minimum price at which a lot will be sold.
A 18% Buyers Premium for Live Online/Proxibid bids will be added to the final hammer price. Pennsylvania residents pay a 6% Pennsylvania sales tax, which applies to hammer price, buyers’ premium and applicable shipping charges, unless the buyer possesses a valid Tax Exemption number. Buyer must complete a Pennsylvania Tax Exemption form and supply the auction house with a copy of his/her resale license prior to the auction.
The purchaser agrees to be legally responsible for payment. Bidder accepts responsibility for all shipping, handling and insurance charges Payments. accepted include Visa or Mastercard.
Detailed condition reports are not included in the catalogue. The absence of a condition statement does not imply that an item is in perfect condition or without imperfections or signs of aging. Prospective bidders agree, it is their responsibility to examine lots in person, by agent or by contacting an auction representative to clarify any condition concerns prior to bidding. Condition reports can be provided by phone or e-mail. Any condition reports expressed is provided as a courtesy to the prospective bidder and is only an expressed opinion and should not be interpreted as fact. All measurements are approximate. Buyer agrees to hold harmless Cook and Cook and its employees bears for any omissions or errors.
Buyer agrees to remove any and all property from auction premise within 7 days of the auction. Cook and Cook shall not have liability for any property damage left on its premises for more than 7 days after the sale.
In-house shipping is provided as a courtesy to the buyer. Shipping, packaging and handling of purchased goods is at the risk and expense of the purchaser. Buyers are required to prepay for goods prior to packaging and shipping. Buyers will be required to make two separate payments. As a courtesy to the buyer, Cook and Cook will arrange for in house packaging, shipping and insurance, unless otherwise noted in the item description. All shipping, handling and insurance fess must be paid by the buyer. Please be aware that heavy and/or oversized items are costly to package and ship; it is not uncommon for the price of packaging and shipping to exceed the hammer price. Returns will not be accepted as the result of shipping/handling costs. We do not accept responsibility for damages. Regardless of shipping method, Cook and Cook must receive cleared payment for item, shipping, handling and insurance prior to release purchase to shipper. Shipping may take up to four weeks after payment is received. The minimum packaging and handling charge is $15.00. We charge for time, packaging materials, plus the actual shipping and insurance price. We generally use UPS or USPS, fully insured. Merchandise is shipped in order of payment receipt. Our shipping co-coordinator will contact you via e-mail after your item has been prepared for shipment and related expenses have been calculated. Please be aware, there are instances when the cost of shipping, handling and insurance exceed the actual hammer price. Shipping charges are not refundable.
Our shipper is willing to ship just about anything. Please contact him at sagellc@aol.com for shipping quotes on large, fragile or unique items prior to bidding.
Successful bidders are responsible for the collection/shipment of their purchase and must be removed from the auction house no later than 14 days after the close of the auction. Failure to do so will result in a storage fee incurrence of $25.00 per day per item, without exception.
For non-in-house shipping, the buyer agrees to arrange and make payment for shipping and other related fees directly to the shipping service. Buyer agrees to provide Cook and Cook Auctions with a signed authorization for the release of purchased merchandise that states your name, address, sale date, lot number and choice of carrier. Cook and Cook will not be responsible for any damage or loss to property left after 14 days of auction.
Cook and Cook Auctions is not responsible for loss or damage occurring during shipment. It is imperative that the buyer file a formal claim with the shipping firm to recover any losses incurred. Under no circumstances can the claim exceed the hammer price, not including the buyers’ premium. Shippers do not acknowledge buyers’ premium, shipping or handling expenses as a requisite part of the sale amount.
Returns are generally not accepted; all auction sales are final. If it is determined that Cook and Cook Auctions have erred in their catalogue description; returns will be accepted. Returns must be made within 14 days of the auction without extension unless arrangements are made within the initial 14 days.
Upon bidding on an item, buyer acknowledges that he/she has read, understands, and agrees to the Terms and Conditions.
