AUCTION TERMS OF SALE PLEASE NOTE: ALL BIDDERS AND OTHERS ATTENDING THIS AUCTION AGREE THAT THEY HAVE READ AND FULLY UNDERSTAND THESE TERMS AND AGREE TO BE BOUND THEREBY. IDENTIFICATION: ALL BIDDERS ARE REQUIRED TO HAVE A BIDDERS NUMBER TO BID AND TO GIVE THEIR FULL CORRECT NAME AND ADDRESS. ADDITION TO OR WITHDRAWAL FROM SALE: The auctioneer reserves the right to withdraw from sale any of the items listed or to sell at this auction items not listed, and also reserves the right to group one or more lots into two or more selling lots or to subdivide into two or more selling lots. Whenever the best interests of the seller will be served, the auctioneer reserves the right to sell all the items in bulk. DISPUTE BETWEEN BIDDERS: If any dispute arises between two or more bidders, the auctioneer may decide the same or may immediately put the lot up for sale again, and resell to the highest bidder. The decision of the auctioneers shall be final and absolute. RESERVE: The auctioneer reserves the right to reject any and all bids. On lots upon which there is a reserve, the auctioneer reserves the right to bid on behalf of the seller. CONDITION OF ITEMS SOLD: The auctioneer shall not be responsible for the correct description, authenticity, genuiness of or defect in any item, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any correctness, error in cataloging, or any imperfection not noted. No deduction will be allowed for damaged items. All items are sold "AS IS, WHERE IS" AND WITHOUT RECOURSE. TIME OF PAYMENT: All bills must be paid in full before leaving the premises on the day of sale. MANNER OF PAYMENT: All bills must be paid to representative on the auctioneer at the auction unless otherwise announced. The full purchase price on all lots sold to the same buyer must be paid within the time herein specified and before removal of any of the items. COMPLIANCE WITH TERMS OF SALE: Upon the default of payment of bills in full within the time herein specified, the auctioneer in addition to all other remedies allowed by law may retain all monies received as deposit or otherwise, as liquidated damages. Lots not paid for and removed within the time specified herein may be resold at public or private sale without further notice, and any deficiency, together with all expenses and charges of resale, will be charged to the defaulting purchaser. REMOVAL: Removal of purchased items shall be at the expense, liability and risk of purchaser. Purchased items will be delivered only on presentation of paid bill. The auctioneer shall not be responsible for items not removed within the time herein specified and shall have the option of removing and storing at the expense and risk of the purchaser any item purchased, but not paid for and removed within the time specified. NON DELIVERY RESPONSIBILITY: AUCTIONEERS SHALL NOT, IN ANY EVENT, BE LIABLE FOR NON DELIVERY OR FOR ANY OTHER MATTER OR THING, TO ANY PURCHASER OF ANY LOT, OTHER THAN FOR THE RETURN TO THE PURCHAS ER OF THE DEPOSIT OR SUM PAID ON SAID LOT, SHOULD THE PURCHASER BE ENTITLED TO IT. PERSONAL AND PROPERTY RISK: Persons attending during exhibition, sale or removal of items assume all risks of damage of or loss to person and property and specifically release and hold harmless Rine Auctioneers, Thomas D. Rine, their employee's, and agents from the liability therefore. Rine Auctioneers, employee's and agents along with their principals shall not be liable for damages caused by any defect in or condition of the premises on which the exhibition, sale or removal of items is held. RECORD: The record of sale kept by the auctioneer will be considered final in the event of any dispute. AGENCY: The auctioneer is acting as an agent only and is not responsible for the acts of its principals. Rine Auctioneers, if not the same as auctioneer, shall have the rights, protection and benefits afforded the auctioneer as set forth therein. ADDITIONAL TERMS AND CONDITIONS: Any additional terms or conditions of sale, may only be added by auctioneer and shall be announced prior to auction. Payment will be made by cash, Company check, Visa, Mastercard or Discover – WE DO NOT ACCEPT AMERICAN EXPRESS.
