Purchases made under $2,500 will be automatically charged to the card on file with Proxibid. If your total purchase is more than $2500, the balance must be paid via cash, cashiers check, or bank wire ($20 Charge). No exceptions.
Items must be picked up during the specified pick-up dates and times. Failure to do so may, at the auction house's discretion, lead to forfeiture or daily charges. Please contact the auction house PRIOR TO BIDDING for any special arrangements that you may need. Only a written agreement with Auctioneer or Auction Coordinator can modify these provisions.
Buying as is, where is with no contingencies, warranties, or returns of any kind. Buyer's premium on all transactions. No titled vehicle will leave premises until funds clear. Not responsible for any lost, stolen, or misplaced items. Not responsible for any accidents. The buyer takes full responsibility for all items purchased. Although obtained from sources deemed reliable, the Auctioneer makes no warranties or guarantees as to the accuracy of the information herein contained. Bidders are encouraged to thoroughly inspect the items in which they intend to bid prior to sales. Absolutely no items will be removed until the auction is completed. Subject to additions, deletions, prior sale, and confirmation.

A 25% cash deposit via wire transfer may be required if you are not known to the Auction Firm. Failure to make the required deposit may result in the cancellation of bidding privileges. Your invoice will be emailed to you at the conclusion of the auction.
In default of payment of invoices in full within the stated time, Rosen & Co., Inc/Buddy Barton Auctions and Auctioneer may retain all funds received as deposits as liquidated damages. Lots not paid for or removed within the time allowed may be resold at public or private sale without further notice. Any deficiencies and other expenses of resale will be charged to the defaulting purchaser. Some equipment must be removed by authorized riggers and contractors only. Riggers must present Rosen/Buddy Barton with a valid commercial general liability insurance certificate in a minimum amount of $2,000,000.00 combined single limit per occurrence naming Rosen & Co., Inc./Buddy Barton Auctions as additional insured. Any hydraulic fluid removal and/or oil leaks are the undersigned`s responsibility to remove and clean up. The undersigned purchaser and/or rigger/contractor must take full responsibility for compliance with applicable environmental laws and exercise all reasonable care to ensure that there is no release to the environment or any hazardous wastes or substances as defined in applicable Federal, State, and Local Statues, Regulations, Rules, or Ordinances.

Any special arrangements or services, IF AVAILABLE, and at Auction House's sole discretion, may be subject to an additional fee; these services may include, but are not limited to: pick-up arrangements outside of posted days and/or times, forklift loading, and daily storage.
The successful bidder, purchaser, vendor or any other company or person engaged and retained to remove the Claimed Assets from the Site shall be licensed and bonded within the State of Ohio and shall present to the Land Bank proof of liability insurance for not less than $1,000,000.00 per occurrence and $2,000,000.00 general aggregate three (3) business days before removing any Claimed Assets from the Site.
The Land Bank shall be expressly identified and designated as an "Additional Insured" on any policy of liability insurance held by the successful bidder, purchaser, vendor or any other company or person engaged and retained to remove the Claimed Assets from the Site. Proof of this requirement must be submitted to the Land Bank three (3) business days before removing any Claimed Assets from the Site.
The County Land Bank and Local EPA may/will be on-site during loadout. As such, loadout will be during specific weekday hours, and all work must be completed before August 12, 2023
Successful bidder must take all items of personal property in total and cannot separate, dismantle any machinery, equipment, or other items that may contain asbestos or other harmful contaminants.
