The auctioneer has the sole discretion to advance the bidding and may reject a nominal advance, should it, in his estimation, prove injurious to the auction. Should a tie or a dispute arise between two bidders, the auctioneer may, at his discretion, reopen the bidding until the property is sold. 7. R2BA Auction Company LLC shall not be held responsible for any bids or bids unseen by the auctioneer. R2BA Auction Company LLC is providing Internet pre-auction and live bidding as a service to the Bidder. Bidders acknowledge and understand that this service may or may not function correctly the day of the auction. Under no circumstances shall a Bidder have any kind of claim against R2BA Auction Company LLC. or anyone else if the Internet service fails to work correctly before or during the live auction. R2BA Auction Company LLC will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the pre-bidding feature and leave their maximum bid 24 hours before the auction begins. When the auctioneer declares an item it becomes the property of the buyer and at that time the buyer assumes full responsibility of the merchandise. Bidder agrees that this agreement shall be governed by the laws of the state of Texas and hereby grants sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction. Bidder agrees and grants that service of process on them may be obtained by mailing a certified letter, containing a summons, postage prepaid, to them at the address they provided to register. Should a dispute arise between R2BA Auction Company LLC. and a Bidder, Bidder waives any right to a trial or hearing in a court of law and agrees to settle the dispute through binding arbitration in Texas. 10. R2BA Auction Company LLC, may refuse a buyer's number to anyone for any reason. 11. All announcements made day of auction take precedence over any and all written or verbal statements. 12. A 20% internet buyers premium applies to all items sold to internet buyers. Shipping charges associated with the shipping of items purchased are the responsibility of the buyer. ALL SALES ARE FINAL. While descriptions are believed correct, the auctioneers or owners make no warranties or guarantees as to genuineness, authenticity of, or defect of any items and will not be held responsible for advertising discrepancies or inaccuracies.
