BIDDERS WITH UNPAID INVOICES, WHO DO NOT TAKE ACTION TO REACH OUT TO AUCTION COORDINATOR TO PAY THEIR OUTSTANDING INVOICE, WILL HAVE THEIR CARD ON FILE WITH PROXIBID CHARGED. IF THE CHARGE DOES NOT GO THROUGH, THEY WILL BE REPORTED.

Items must be picked up during the specified pick-up dates and times. Failure to do so may, at the auction house's discretion, lead to forfeiture or daily charges. Not responsible for any lost, stolen, or misplaced items. Not responsible for any accidents. The buyer takes full responsibility for all items purchased. Although obtained from sources deemed reliable, the Auctioneer makes no warranties or guarantees as to the accuracy of the information herein contained. Bidders are encouraged to thoroughly inspect the items in which they intend to bid prior to sales. Absolutely no items will be removed until the auction is completed. Subject to additions, deletions, prior sale, and confirmation.
ALL PURCHASES MUST BE PAID IN FULL ON THE DAY OF SALE.
Buyer Registration is to be completed in full online with a valid Credit Card.
A 25% cash deposit via wire transfer may be required if you are not known to the Auction Firm. Failure to make the required deposit may result in the cancellation of bidding privileges. Your invoice will be emailed to you at the conclusion of the auction.
In default of payment of invoices in full within the stated time, Rosen & Co., Inc/Buddy Barton Auctions and Auctioneer may retain all funds received as deposits as liquidated damages. Lots not paid for or removed within the time allowed may be resold at public or private sale without further notice. Any deficiencies and other expenses of resale will be charged to the defaulting purchaser.
Some equipment must be removed by authorized riggers and contractors only. Riggers/Contractors must present Rosen/Barton with a valid commercial general liability insurance certificate in a minimum amount of $2,000,000.00 combined single limit per occurrence naming Rosen & Co., Inc./Buddy Barton Auctions as additional insured. Any hydraulic fluid removal and/or oil leaks are the winning bidder's responsibility to remove and clean up. The purchaser and/or rigger/contractor must take full responsibility for compliance with applicable environmental laws and exercise all reasonable care to ensure that there is no release to the environment or any hazardous wastes or substances as defined in applicable Federal, State, and Local Statues, Regulations, Rules, or Ordinances.

When purchasing any machine that is hardwired or plumbed, purchaser is entitled to the machine and applicable control panel (including, unless otherwise stated, the wiring between the panel and machine). Purchaser will not receive any additional electrical boxes, wiring, piping, breaker boxes, and/or junction boxes. All fluids must be drained and removed from the premises by the purchaser or designated rigging professional in an environmentally friendly fashion as to create no hazard. All disconnections of equipment from utilities (unless otherwise noted) will be made by purchaser at their sole expense and in accordance with all safety rules and regulations; this includes, but is not limited to: capping of electrical wiring, piping, filling in pits and closing of openings to the outside environment. At auctioneer’s sole discretion, a financial deposit may be required to insure that such disconnection from, and repairs to, the structure from which items are being removed are safe and the premises protected from damage or weather intrusion.
