Sales tax will be added to the purchase price of all taxable items.
All items sold As-Is, Where-Is; no warranties or guarantees on any items. All sales are final!
You must be a registered bidder to bid. Nichols Equipment Inc, Auction Division, reserves the right to refuse the registration of any person who does not comply with registration guidelines.
All items must be paid for in full before item can be removed from the property.
We do have some reserved bids. We want to sell all items.
We do have security on site. You must show paid receipt before you can leave with any item.
All announcements from the auctioneer take precedent over all other printed material.
A 3% discount will be given if paying by cash or check.
BUYER’S RESPONSIBILITY
Buyer accepts full responsibility of removing purchases from site. Auctioneer is only Agent for the Seller. Everything sold “As Is – Where Is”. Buyer is relying on their own inspection for all purchases. Buyer has read all terms and conditions on the catalog and brochure. By signing, Buyer hereby agrees to all the stated terms and conditions including all announcements made by the Auctioneer regarding this auction.
BUYER’S ACKNOWLEDGEMENT
I am working on the auction sale premises under my own risk and release the Property/Business Owners/Auctioneer from any liability should an accident occur. If asked, I will provide proper insurance documentation for all Employees. Buyer or Buyer Personnel are responsible for any damage to Structures or Personal property of the Seller before they leave the premises.
ACCEPTABLE PAYMENT
Payment is to be paid by cash, credit card or check (If accompanied by current bank letter verifying sufficient funds). All material to be paid in full the day of the Auction.
BUYER’S TAX STATUS
If the tax is not paid on this invoice, by signing this statement the Buyer claims to have a sales tax ID number and must furnish it if required. Buyers accepts all penalties if provided tax number is not appropriate for the tax law of the state the auction is being held.
ITEMS PURCHASED
Storage, removal and loading agreements made between Buyer and Seller are not the responsibility of the Auction Company. Auctioneer/Auction Company is in no way liable to any storage, removal and loading agreements made between this Buyer and Seller regarding purchases made at this Auction.
Items not removed by date set by Auctioneer will revert back to the Seller. All loading and pick up of stock is to be done with Nichols Equipment Inc. Personnel present. Please phone in advance to set up an appointment before removing items. Call 843-761-6750
All property is sold “AS IS”, and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Nichols Equipment Inc. may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall Nichols Equipment Inc. be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value.
Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Nichols Equipment Inc. shall endeavor to describe in detail each item and any pertinent information about it. Nichols Equipment Inc. will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase.
Nichols Equipment Inc. is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Nichols Equipment Inc. or anyone else if the Internet service fails to work correctly before or during the live auction. Nichols Equipment Inc. will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Nichols Equipment Inc. reserves the right to withdraw or re-catalog items in this auction.
